Sorry ayu it would'nt work as you would have signed a pay or play contract with them which means that if you then decided not to use there services anymore you would still have to pay them or you would obviously pay them if you recovered ppi, sorry to be the bearer of bad news but unfortunately they have you i'm afraid, all the best, steve
Thanks Stevethe weird thing is that after all this time I got a letter from them just hours after I posted here saying that RBS have agreed to pay me full compensation and interest!
I guess I will have to bite my tongue and admit that though iSmart were slow they got there in the end.0 -
Hi, I posted a few days ago but not heard back.
I am claiming for mis sold ppi's through HSBC. I called them and they said I had 4 loans with PPI's against them. I have written a letter to request it back. I no longer have any loans with them or the paperwork so I am hoping they still will. I do remember years ago when I took out the loan I was told once that if I died my loan would have to be paid by my parents if I didn't have PPI. That is wrong isn it? for an unsecured personal loan. Hopefully I will get something back, but I just don't know how much.. eek
I feel with the loans you have a fairly good chance of a reclaim, hsbc are not too bad but do try to get you on the 6 year claim back clause, i did 5 loans another one which they told me about and whilst the reclaim was a bit lower than i'd hoped it was quickly paid out.0 -

I'am a brand new member of the forums, long time errm money savingexpert websiter!
Well I've now started teh ball rolling with PPI reclaiming on two loans I had with Santander (then Abbey) in 2005 which I have since paid off as of a year or two ago.
Anyway I just wanted to post a timeline of what I've went through so far...nothing to stressful...YET!
9th November 2011:
Sent 2 reclaiming letters along with 2 of the original loan paperwork to Santander (not recorded stupidly) in 2 separate envelopes.
10th November 2011:
Received a phone call from Santander the very next day asking if I would like to confirm to carry on with the reclaiming process and also informed me that abbey would uphold I had been misold. I asked if they received my other loan with they replied no, so I faxed the missing one and phoned them within a few minutes of sending it and they confirmed receipt so now they've got 2 of my PPI reclaiming cases.
13th November 2011:
Contacted Santander via telephone and asked for an update, they said they had sent me a letter (3 days ago) out confirming the ppi claims where filed and with a case handler and would be dealt with within 7 weeks.
14th November 2011:
Phoned and asked for another update and also the case reference for both, this was given to me and also was told that abbey would uphold the ppi claim that I was misold it.
I know its only very very early days but I intend to use a few minutes of each day of every lunch hour to chase my case up
Initial PPI claim of around £2500
8% Liability charge (which the court would award) of around £1707
I'll be posting on here on a regular basis until I have the money I'am owed, I'am a very patient person but after the years and years I've put up with Santander/Abbey chasing me for payment for things...now its time to hassle them...QUEUE EVIL LAUGH MWUHAHAHAHAHAHAAH!0 -

Can I ask though, was it wrong of the bank to say if I died my loan would need to be paid by my folks?I don't want to claim this if it's true lol. think it was a 12K loan with PPI Thanks x0

Hi Guys
I had a Nat West credit card that I paid off a year ago.
I spoke to Nat West using there "PPI" phone number & a week later they sent me a PPI questionnaire to complete.
Now all the details I have is an old statement or two for a card I had for about 15 years.
Is there a way of getting ALL my details from Nat West ? Is there a pro forma letter I can use to write to the the bank to ask for details ?
The only details I know for sure is that I did apply for a card in a branch and on reciept of my first statement there way PPI but I assumed it was a condition of having the card and went with it.
Now all these years later I realise this is illegal.
But the fact I dont have many details I guess will count against me so need the bank to help ( a bit like Turkeys voting for xmas )

Usually if you die and you owe unsecured debt, they would apply for money from your estate, however, if you dont have any assets they cant chase families for the debt as it wasnt secured against anything, unless they were acting as a guarantor. Your estate would consist of any assets plus insurance policies.

Nope def don't have an estate and they didn't act as guarantor.. grrr cheeky things.. I wouldn't have chosen to have PPI's if I didn't feel I wouldn't have got the loan without it. I should have done this sooner!
