Got a letter in this morning saying they are unable to uphold my complaint:-
After considering the information and documentation available to us...I can assure you that that I have fully investigated the sale of PPI using any relevant documentation held by us.
As part of my review I have considered whether you were eligible for the policy, if it was suitable for you in relation to PPI policy when you took it out. I have also taken account the concerns you raised in your complaint as a whole to ensure we acted fairly, taking into account any other relevant circumstances or information that may be available.
As a result I am satisfied that that there were no issues with the sale of the PPI attached to your credit card.
I requested SAR and the only documentation that they have from then (1996 when card opened) is the application form, no terms and conditions. So I presume they are basing decision on the application form.
This was filled in by a bank employee, Handwriting not mine, however the box is ticked, not by me I may add.
The signature box was on another page which I have obviously signed. I was filling in documentation for mortgage at time and got credit card as part of that deal (was guaranteed for mortgage customers)So filled in a few forms that day.
I was on rolling temporary contracts at the time, employer had to write a letter stating how long I had worked there etc for mortgage purposes - they accepted this.
My complaint was I didn't ask for it, nor wanted it.
I don't recall ever getting asked about PPI, I never asked for it, the limit on the card started of at £1000 and was very rarely used, latterly 7 years later, I used it and it was at its max.
I got into financial difficulties and had trouble paying the minimum payment, it is not until I phoned in 2008 with regard to payments, the advisor made me aware that I had this insurance and should cancel it, as was paying aound £50 to it.
I know that I must appear stupid, as this was on my statements, I thought it was compulsary.
If I had known it was optional, then I would have cancelled it years ago, because I was really struggling and this was adding £50 to my mimimum payment.
The complaint has been left opened at present I have the option to phone and redress some of the issues that have been raised.
Do you think I should follow this up, do I have a case, the PPI was added without me asking for it?

OK, so its Lloyds TSB again ?? The fact is that if you did not request the PPI, then who added it your account ? This was done with a member of Lloyds staff guiding you through
You must be very firm with them and state that you did not agree to the PPI at the time and that the box was ticked without your permission.
This is fraud under the Fraud Act 2006, it is not the first time Lloyds or other banks have done this without the knowledge of the customer,
the staff are trained to sell these policies as they earn commission and have targets to meet so it is very easy to get your signature and tick the box later, there are many cases of this happening of late. It is theft and fraud.

You need to send a severe letter of complaint to the CEO of Lloyds Bank pointing out this fraudulent act and ask what is he going to do about it. The licence issued to these banks by the FSA does not include fraud
THIS IS THE MAN TO EMAIL WITH YOUR COMPLAINT
The chances are now very high that Lloyds will end up in court as did MBNA.
You should also send a written complaint to the FSA about this.
And by the way, the letter you received stating the following:

You may have been eligible if you had agreed to it in the first place, this point has gone over his head0 -
I got straight through on the customer care(!!!) helpline today.
They are paying today offer letters dated end of August, thats 8 weeks. It seems 40,000 are on the payment schedule.
I pointed out that I can personally make 200 BACS payments in a working day, thats 1000 a week, so 20 staff could clear the 40,000 in 2 weeks. Reply, no, the payment department isnt that big!!!! Big??? 20 staff????? and there could be further delays if the BACS system goes down (that doesnt happen very often, poor excuse).
I suspect the actual payment staff are on a 'target' for each day of around 30 payments, for which they will no doubt receive a nice bonus.
Should we suggest Lloyds employ a few more clerks in the payment department?????
Result is higher still BP and a wait of 8 weeks MINIMUM. Christmas shopping Xmas Eve and probably debt collectors before then.0 -
Everyday now, this and other forums are telling the same stories of theft and fraud being conducted by Banks
** LLOYDS BANKING GROUP
** ROYAL BANK OF SCOTLAND GROUP
** CAPITAL ONE
** MBNA
** .... and the rest.
They have abused their power to such a degree that consumers can no longer trust them
DON'T BUY ANY INSURANCE FROM A BANK
Even if the say it is the only way to get a loan or credit card ... WRONG
If you need to take out insurance for whatever, seek the services of a Financial Advisor who is fully licenced by the FSA to offer such a service and make suggestions of good companies to deal with.
Most of these Financial Advisors are individual people whose living depends on giving good advice.
You can search the internet in your local area, look in your local yellow pages, ask friends if they use one, see an accountant, they will suggest one, your solicitor may help as well. Local private Insurance brokers are a good source.
THE BANKS CAN NO LONGER BE TRUSTED, ALL THEY WANT TO DO IS LINE THEIR OWN POCKETS AND FAIL TO GIVE GOOD ADVICE.

That is an amazing figure, 40,000 payment schedules and for just ONE BANK ??
Even if everyone got £500 back each that amounts to an incredible £20 million ... HOW CAN THE BANKS SUBSTAIN THIS ???
