I think Im going to ring Lloyds and tell them I know their offer is too low and can they recalculate, see if they submit! I only hope they dont ask me what I think it should be! Has anyone done this??0

Good morning to you all.
Can I ask for some help please. I put in a claim to Tescos back in May regarding PPI on a credit card - was not working at the time. The card went back to 1999 to 2001 (but not sure when it actually finished). Tescos could not find me and as the card is no longer active wanted to close my complaint. Luckily I had some old statements and sent just three off to prove who I was etc., as even though I had given them the credit card number they still could not 'find me'.
Today I have received an upheld letter from Tescos, rightly so. However, because they can not find any details on me have only worked out the offer figure on the three 'sample' statements that I sent to them. I sent them three statements, one for 1999, and two for 2001. I have rung them today requesting the 'close' date of this card, they cannot tell me this, but I have asked them to email me so that I can contact them easier as their phone line if always busy.
Now I do not have many statements at all, only 21 over the three years that I am aware off, even though once they give me a closing date I should know more. These statements having missing odd months, but Tescos will not pay back any PPI deducted on the missing statements, even though to me they can tell from one to the other that credit was still on that card as the PPI from one month to the next is very similar at around £6.50 per month.
Can one of you please advise me on this. I feel that Tescos should be basing their refund on an average of what the balance was on the card - they will have 21 months to base this average on - so as to fairly refund me what rightly should not have been taken in the first place. Hope this makes sense, I do ramble on sometimes, but just wonder where I stand because I am sure other banks do 'average' out what is owing. Thank you in advance0 -

I dont know if this will help but, i had a loan with lloyds back in 1995 and no paperwork could be found either ends, any ways Lloyds paid me £1200 as FOS guidelines state incases like this...... I know it may be different with a CC but ive never had one so dont know how they work, might be worth phoning FOS and asking them........:D:p Perfer et obdurai dolor hic tibi proderit olim

Hi Bev, if it has been upheld, then they have the information on their system. Write/email them, saying you require a refund back dated to the start of the PPI. They are obliged to retain records and the onus is not on you to provide statements, the onus is on them to confirm they have a full record of this PPI.

Thank you for your reply - they insist this is not a ploy. I said if I was to send a SAR they still would not have any information they could send me - not in archive records. I obviously have some, but nowhere near enough.
I am at work so have not managed to ring FOS yet, but do you think this is my best move forward to send a SAR? Who are the organisations I should be quoting?0 -
Hi me again, with an update.
I have spoken to a really helpful gentleman at the FOS with regard to my complaint with Tescos and they stating they will only pay me back the PPI wrongly taken from me if I can prove to them by sending statements etc., as because my credit card I had with them went back further than 6 years. Tescos confirmed to me when asked that they do not hold any information older than 6 years, not even in their archive records department, and if I were to send a SAR to them, they would not be able to help me. The FOS think this very strange because if I owed Tescos money, they feel sure they could refer back to old records. FOS are sure that Tescos would hold historic database records, and would like to take my complaint forward on my behalf.
So thank you to The Marksman and Beamerguy for pointing me in the right direction. Now to write my return letter to Tescos confirming that I will not be accepting the £29 offered to me, and that I have referred my complaint to the FOS. I have also been waiting 23 weeks for a response from Tescos, and now still stalling tactics. I will keep you all posted.0 -

Dear Sir,
Despite many requests for you to provide a copy of the PPI policy that St Andrews provided to MBNA to offer to their customers, you have failed to do so. It appears that there are more than just one policy available, all seem to differ.
As you are licenced by the FSA to provide financial services products and to be transparent in the way you conduct your business, I can only assume that Lloyds Banking Group and St Andrews have something to hide.
Therefore, as you refuse to provide details on one of your Financial Services Products, I am requesting the FSA to provide that information to me
