on the talk of cars..(bub-bum) i posted a thread a few days ago to ask advice on what to do about a car finance agreement that had a totally different signature on the PPI part - in a nutshell we contacted volvo who stated that ford were the providers, who in turn said it was the dealership. I wrote and complained stating that the signature was completely different on the agreement - to which they agreed, however, after sending them several emails, they responded last week to later that they can not do anything.
We contacted the FOS and CAB who stated that they couldn't do anything (post 2005), however, if they are issuing a final response, we can find out who the underwriter is and complain that way. I have sent 3 x email now and they are totally not responding...what can i do now? They aren't even interested that this is fraud either - can we threaten to go to the papers/police?? xx

Only a thought sunny you could threaten to contact watchdog mate, might do nothing, but it might be worth a try these firms don't like to be in the spotlight for all the wrong reasons.:):)

Can you just confirm my understanding of this
    1: You purchased a Volvo
2: The Finance was done by Ford Credit
3: Who sold you the PPI ?
4: Who do you think signed the PPI agreement if not you
5: Did you agree to the PPI ?

Yea, bmw (ha) we bought a car from a Volvo garage in 2001, were shredding old stuff in the loft and came across an unopened envelope with Lloyds on (the garage), it was the agreement, when we looked at it - hubby had signed on one side for the credit, but on the other side was a ppi box with another bad copy signature on of my hubby's. Stupidly, at the time, he must of knew it would be a copy of the agreement due to the envelope, and put it in a safe, dark, never to be found place until now!! We contacted Volvo head office and got a letter back from Ford stating that they provide Volvo's finance  but as it was 2001 - they couldn't do anything.

Hubby rang Ford to state he didnt know he had it & did not sign for it and the proof was in front of him..they recommended that he contact the garage he bought it from as it was them who would be liable - to which he did. And here we are now...them stating that the signature is very different from my hubby's but they are not liable..?? What do you think? :o xx

Didn't think of that - it was my daft hubby's fault...he was and remains to be mustard with just putting things out of the way, obviously he knew it was the agreement and had no reason to check it really as he knew from walking away from the garage what we would be paying etc, as it was him that told them what price he wanted to pay, but low & behold there was £35 a month incorporated in his payment... so it has remained in the envelope until 3 weeks ago..it is so obvious it isn't his...but to be honest, he really should of opened it at the time & looked at it...young and daft :o xx

Are you saying that the PPI was with Lloyds ?

If, it is not your signature then it is fraud and there is no timescale
Someone signed it, Ford are 100% liable if one their staff committed fraud

It definatly is not his signature beamer, but it's his fault for not checking really , i stated that it is fraud and he has the agreement to prove it but they said they are not liable. We have no idea who the ppi was provided through and i have asked them to forward this information, we rang the FOS yeaterday for advice as we didnt know how else to tackle this as it is blatant fraud, the FOS said as it was 2001 they cannot do anything without the underwriter but if we do find out who the underwriter is they can do something as it isnt my hubby's signature, but it just looks like the garage are sweeping it under the carpet, probably because it was 2001...thanks for your advice :):) xx

Sunny, fortunately the law allows situations whereby contracts are not carefully read. You must now request the garage/finance company to provide you the name of the person who signed the agreement purporting to be your husband. You also require the name of the company who the PPI is with. You also believe that fraud has been committed and therefore, you require the full information in preparation for a police report
