    Hi Di
No it's not being dealt with by the FOS as the letter from RBS agreeing to pay a goodwill gesture arrived the day I was sending in the FOS forms. I can't believe they haven't come up with an offer figure yet and there doesn't appear to be an end in sight yet!
I don't know if I am just being fobbed off by the 'New Process' excuse, but I really don't want to go to the FOS as I believe it is a 9 month wait.
    Thanks

Hi hun arh right I see.

Well in this case I would keep on at RBS and tell them you need a figure quickly or tell them you will just have to continue to go to the FOS otherwise.

But yes unfortunately these type of complaints are getting higher by the year with the FOS and can take a while, from a few weeks to even a year or even longer in complex cases, but maybe you should tell them you will appreciate to receive this by 14 days or you will move this on, - this may help, "hopefully", I know you've already been waiting long enough already, and how frustrating this is for you....... , but try by emailing/writing to them to see if this will shift them, it seems to be the only way at the moment I think hun.
I'm sure they would prefer to come up with an offer for you and send you the figures than you take this to the FOS.

Maybe someone else will come up with some ideas for you here as well.;)

For those who have been told that their claim is time barred or the broker or lender was not regulated by the FSA ir GISC at the time. Please ignore this stance. It is a total red herring. You may not be able to make a claim through the traditional FOS route but you can still definitely expect to successfully claim.
    thanks for that .cheers

Perhaps it is them that should prove that you rang them Simon. I think this is the usual fob off.:D That is also !!!!!!!! that they do not cold call and that they are not allowed to. They are not allowed to look your number up in the phone book and call you but they probably had your telephone number when you took out the loan so that is not in fact cold calling. I had one that was A and L now MBNA and they upheld the complaint and that was with a cold call to sell PPI insurance on a credit card. Know that was different to yours but am sure if they do for CC they do for Loans. Take them to the FOS.
took the words right out of my mouth!!!

    Hiya Max, hope your well.

    You have a good point here Max......:D :T ;) .

However Simon is unable to take this to the FOS as they (MBNA) confirmed to him they were not under jurisdiction of when he had taken this out.

But Simon has been in touch with the FLA who have registered his case.

I do think maybe getting in touch with the ICO may help, what do you think?
As he did SAR them as well.;)

It should not. If it was over 5000 then you could try other things if you have exhausted every other route and they are not being helpful and you feel strongly that you have been miss sold. Am sure you are aware of this anyway.

  • Hello again! Really hope everyone is doing well? ;)

Had four letters today from the FOS confirming receipt of our complaints to MBNA, Barclaycard, Lloyds and Monument.

Judging by the amount of time it takes it should be a nice christmas present then eh? :rotfl:

Never mind without you guys it would never have got this far xxx
