An SAR can be useful to help your case, so with a bit of luck something within the SAR will help support your case.
And hopefully there will be a copy of the recordings of any telephone calls made, if not there should be transcripts of dates and times of calls, with maybe what the conversation entailed.
You can still write back to them now, have they given you a certain time to get back to them for them with more information in order for them to reconsider your complaint?
or if its not long before your expecting your SAR to arrive, see what comes back first, but try to write back to them with a 2nd stage letter if they have given you a timescale for this.;)
They have given me 4 weeks to reply. So I'll write the 2nd stage letter tonight and post that tomorrow.

Good luck hun and with a bit of luck your SAR should be with you before the 40 day deadline they have, but even if you do write back to them now, anything that is useful within the SAR can be useful later on.;) :A

hey joe, i think there is a song in there somewhere!. thanks for your reply unfortunatley they are saying that they will not enter into anymore correspondence with regards the matter so i do not see how i can get them to prove anything
Perhaps it is them that should prove that you rang them Simon. I think this is the usual fob off.:D That is also !!!!!!!! that they do not cold call and that they are not allowed to. They are not allowed to look your number up in the phone book and call you but they probably had your telephone number when you took out the loan so that is not in fact cold calling. I had one that was A and L now MBNA and they upheld the complaint and that was with a cold call to sell PPI insurance on a credit card. Know that was different to yours but am sure if they do for CC they do for Loans. Take them to the FOS.:mad:0 -

However Simon is unable to take this to the FOS as they (MBNA) confirmed to him they were not under jurisdiction of when he had taken this out.
But Simon has been in touch with the FLA who have registered his case.
I do think maybe getting in touch with the ICO may help, what do you think?

RBS have still not given me a figure regarding the goodwill gesture. I have called them and they advised that RBS are working on a new process regarding certain types of loans and figures cannot be calculated until they receive the new process from head office. They told me they do not have a timescale for this.
I have spoken to FOS and they told me that they cannot advise me on what to do but the waiting list for FOS complaints is very long.
It's been 5 weeks since the goodwill offer letter and I really don't know what to do next. I'd be grateful for any advice anyone can offer.

And its no bother, that's what we're here for lol, however it may be worth checking on the success thread as well, next to this one, and check out other winners in regards of RBS, and maybe post something on there as well if you want to where they may try to give you some help in what to do in regards of this actual company.
