  • Having sent off my papework to the FOS, I've just received a questionnaire from them (which I already completed via this site) asking me to fill it in (again). I've done this and will return it tomorrow but must admit I'm not confident of getting anything out of this - all because of a little tick box :(

    Hi mrs shazbat, have you got a shorter name lol, we're going to have to keep in touch with our cap 1 claims, i have one going into the actual ombudsman as the adjudicator turned me down even though there was clear evidence of tickbox tampering are still waiting for ombudsmans date cap 1 are dragging there feet about sending the fos more info now, all the best with this. steve

    Unfortunately I can't allege tickbox tampering; I still think the fact that they've never told me it's optional when activating new cards, etc., should count for something but knowing the luck I'm having this year, I think it's unlikely.

    I've recently tried a little experiment with RBS that proves this point entirely.

    I phoned them about an old loan account and gave the account number and PPI policy number. They said they'd look into it for me.

    A few days later they contacted me to say that they had no record of this loan and therefore couldn't investigate.

    "No problem", said I, "I have the original copy of the documentation here so I'll scan it and email it to you".

    So I scanned it but deliberately blurred it a bit so some of the numbers were hard to read. I put a note on the email slightly misstating on the high side some of the blurred numbers 'for clarification'.

    Lo and behold, I got a response from RBS saying that the numbers I'd quoted were incorrect and should in fact be X, Y and Z.

    "How do you know", I replied, "as you have no record of the original loan according to your letter of response to me. If you have no record then how can you know the figures stated by me are wrong ?"

    "Ah", they said, "we have now managed to trace the original documents in our archive".

    "So", I said, "you did have them all along but you just couldn't be ar5ed to look for them and thought you'd fob me off. I wonder what the FOS would make of that ?"

    They have now upheld my complaint in just 6 days :rotfl:
    Its amazing how these banks can't even do simple calculations correctly..............

  • Hi, I am now into week 21 of a claim on a single premium policy sold to me in 2005 alongside my mortgage. Although i have had 3 holding letters i keep getting the same response which is still investigating will respond hopefully in the next 4 weeks. :mad: I am really starting to get frustrated as my last letter from them was 7 weeks ago and no answer to my emails, if i phone i get the same response, we are still investigating, Thankyou for your patience. But my patience is now wearing thin :mad: They have had much longer than 8 weeks. What is my next step ? Didn't really want to go to the Ombudsman due to the timescales.

    As the FSA given these extra times, they were expected to keep within these timescales.
    If your not getting any response, contact the FSA who have given these timescales, who may on your behalf contact them for you, or if you a good local mp, maybe he or she would write to them on your behalf.

    Good luck, and yes I know exactly what you mean with the FOS with the big queues.;)

    hi all can i claim ppi on a credit card if am not working and havent worked for 13 years ive had the card about 2 years now with ltb :)
