    Hi Niggly,
I would like to borrow your brains for a moment. In February 2004, I paid off my loan with The Funding Corporation, at the time, I was unaware that I was charged PPI but when I confronted them, they claimed that it was six years since then and that they will not pay, eventually I contacted FOS who advised me that they will go the Underwriters way, last week I received a letter informing me that the case is a difficult one because AXA the Underwriters who sold the PPI through The Funding Corporation are also proving very difficult and the letter said that they will contact me again in November. This morning I received another letter from them this time from a different person apologising that my case is taking so long to be solved. He also claims that the case is difficult because the underwriters do not want to admit liability. He asked me if I have any insurance certificate, the truth is I did not even know I had PPI on the loan, the only way I found out is when Martin Lewis was asking people to check their loan agreement and request them if they do not have agreements. I was shocked to find that they charged over £2,000 for this PPI. Can you please help me here, I do not have any certificate or other paperworks apart from what I sent to them. I am really confused about the two letters. Do you think I should call them or write to them.

You will not have an Insurance certificate. If you were lucky then you might have recieved the terms and conditions or a copy of the policy. The onus is on them eventually to prove that you did not have the PPI or why they shouldnt pay out. Obviousley there is evidence that there was PPI so its a case of going back to the FOS and tell them you have sent them everything you have.

The FOS will have to put the pressure on the underwriter on this one NOT you. I think its going to be a waiting game until the underwriters buckle. Dont forget they have apologised to you for the length of time. FOS should know that the ppi was written under a group olicy so there is no insurance certificate.

I would wrie back, re-iterate the reasons for the mis-sale and tell them you have sent them all the iformation youhave or were sent.

    BUT
They have only paid me out on 2 numbers shall I contact them re the third number? and if so anyone got the telephone number?

My husband has had an MBNA credit card for many years and pays PPI on it but we do not have a copy of the original application or agreement. Could I ask you how you claimed and what you put in your letter, or did you telephone? He was in teaching when he got the card and would have been well covered for sickness, redundancy etc. Any address or telephone number would be greatly appreciated. Many thanks and three cheers for your win. Well Done. :j

    QUOTE FROM SANTOB

This is the earliest available payment date we hold on record for your account. If you can provide any earlier card statements which show ppi, please submit these and I will be happy to review our offer'. As another kind post added, I have the original application which shows PPI was added in 1998, so surely this should count as 'evidence'? And surely it is up tp Tesco to provide this information, they must have it on record when I was paying PPI? If it was taken out at the time of application then this proves somewhat that I have been paying since 1998?, [/QUOTE]
    Good Morning Santob
Pleased to hear you have the original application form and I am fully in agreement with you.
May I suggest to you to ensure you get a swift answer to supplementary questions to responses you use the quote button to post the question.(note to self, practise what you preach)
I am quite sure that they have full details of your history BUT lets humour them and accept that they don't.
In your position I would send an E-Mail to the CEO of Tesco ( Sorry I don,t have the details but someone will ) politely pointing out that you have the evidence they require and asking them how to proceed.
    .
Al so, does anyone know that if you do not accept the first offer and ask them to consider to review the offer, is there a risk of losing the first offer altogether? Sounds daft, I know, but I don't want to tempt fate. Good news like this doesn't happen to me often so I'm kind of expecting it to go wrong somewhere!
This is exactly the physcology the banks are employing . As I pointed out in my original post, depending on your balances it is quite possible the previous five years could well outstrip the offer you olready have.
They are putting the onus on you to challenge their decision and have in effect said that if you can prove the earlier existance of PPi they will review it.
You are fortunate in that you have that evindence and by bringing to the attention of the CEO as I suggest will ensure a swift and sucessful result

I didnt have the original paperwork either just a selection of statements and the PPI disappeared in 2008.
I put that I never ask nor wanted PPI, i didnt realise that I had it until all the recent hype and that as i was a council employee I had good sickness cover of 6 months full and 6 mths half sickness cover so why would I have taken this out. I also put that I had periods of sickness during the time I had the cover and never claimed because I didnt realise or had it or needed it.
I also put that I had now more knowlegde of my rights and decided to claim.
I posted the claim on 3rd Aug and bingo an offer letter in just under 5 weeks.
Good luck with the claim and everyone on her will help and assist you they are a fantastic bunch
    good luck everyone today

Also, would I be better waiting a few days after sending the letter, so I know FP have received it, before sending the email, just in case 'Bob' has a quick look and notices I've not made further contact?

Sorry for sooo many questions, it's a bit like pushing treacle up hill sometimes :D

that would be a good idea so they don't cross in the post as it were.

Hi offcumden as i was saying to santob yesterday i've had this with hsbc and we've now put in a sar request to force the info out of them as i know they have it.
  • Hi,

Can anybody give me some advice please?
i have been awarded a settlement from llyodstsb but the thing is that they are now dragging their heels in paying out, im sick of being fobbed off with "another five working days", i have lodged two official complaints with them now because they are still continuing to contradict themselves with conflicting infomation (which is why they are in this situation with reclaims in the first place)!!!!, is there anything else i can say to them instead of being fobbed off again? just wondering if anyone else has or are still in the same situation with Llyodstsb.

    Many Thanks
