    I would like to borrow your brains for a moment. In February 2004, I paid off my loan with The Funding Corporation, at the time, I was unaware that I was charged PPI but when I confronted them, they claimed that it was six years since then and that they will not pay, eventually I contacted FOS who advised me that they will go the Underwriters way, last week I received a letter informing me that the case is a difficult one because AXA the Underwriters who sold the PPI through The Funding Corporation are also proving very difficult and the letter said that they will contact me again in November. This morning I received another letter from them this time from a different person apologising that my case is taking so long to be solved. He also claims that the case is difficult because the underwriters do not want to admit liability. He asked me if I have any insurance certificate, the truth is I did not even know I had PPI on the loan, the only way I found out is when Martin Lewis was asking people to check their loan agreement and request them if they do not have agreements. I was shocked to find that they charged over £2,000 for this PPI. Can you please help me here, I do not have any certificate or other paperworks apart from what I sent to them. I am really confused about the two letters. Do you think I should call them or write to them.

    yes a loan for £20.000 7 years ago and just about to finish paying it off in 3 months!!! ppi amount was between £80 and £84 a month for almost 7 years which i work out to b at least £6.000 owed!!! anyway they have not made an admission so dont understand why they r offering anything at all????

  • Ive had a response to my SAR from Santander saying they have no records for me as my account was redeemed in 2003 (mortgage).
    That would be in compliance with the Data Protection Act..

    I am fairly sure i would have had ppi if they offered it to me as I wasnt very clued up back then.

    And I am even more sure that you wouldn't have if they didn't offer it. It is also possible that a broker arranged it, not whichever of Santander's predecessors you borrowed from.

    It is possible that it was a condition of the loan and it is even possible, shock horror, that it was correctly sold - Mortgage PPI sales can largely be defended on the basis that it was recommended as good practice by no less an authority than the Mortgage Code Compliance Board.
    How do i reclaim without my statements??

    You don't because nobody has any evidence that you are entitled to anything.

    hi cappo they are rejecting my claim without merit bect occurred more than six years ago i paid it off 2007


    Write back and tell them you have the right to complain because its only recently you became aware of the mis selling of the ppi, and with it being a settled loan this makes no difference, ask them to review, good luck.

    Eg. Dear Sir,

    In reference to policy number xxxxx

    Please will you get somebody to look into our complaint. I am amazed at the response from FP as this was clearly mis sold.

    Followed by the letter.

    Will this be enough, and I will put the policy number as the subject?

    You could do if you want to, or if you decide to email him now, just make them aware the letter is on the way, and you are requesting it to be reviewed with your reasons, if you posted it by recorded delivery, let him know the track and trace number as well.

    And ask away honey x :D;)
