  • Hi, just wondering if anyone can help. I took out a loan with liverpool victoria in 2004 and ppi was added - mis-sold for sure as I thought it was part of taking out a loan! I phoned to try and cancel the ppi in jan 06 but was told I couldn't. Then in june 08 I received a letter from them saying my ppi was cancelled in march 07 and they refunded my ppi payments back to march 07 along with interest. This totalled 170.17.
    However, I want to claim back the full amount I had paid up until march 07. Can I still do this? On martin's info page about ppi's he says
    "...However before starting the reclaim process there’s one big rule...
    If you have received a payout from the insurance, you won’t be able to say the policy was missold."

    So, where do I stand??
    Somebody please advise!

    Hi Katie

    Did you make a claim with these at all?

    If not check these procedures here:
    I had success with these within a matter of a few weeks.
    Mine was taken out in 2002 and settled in 2003, we were also mis sold the PPI and they did actually make us an offer.

    If you feel you have been mis sold, write to them to reclaim and complain, more details here:

    There is more info on ppi mis selling on the link, and a template letter, but try to use your own words if you can, and of course your own reasons and also check out for more reasons in the link that may also occur to you and add them as well.

    They have 8 weeks to respond in full, another letter maybe required if not successful first time round, but I think you may be okay here, however if not post up and we will help you move on to stage 2.

    Keep a them and post by recorded delivery, good luck.;)

    If you did make a claim for these and this loan is settled, if you feel you did not have a fair rebate at the end of it this is another direction you can take, write to them and tell them you feel your rebate was rather low.........and am requesting for the remainder of the rebate, interest up to the settled date etc.
    If you decide to go this direction, write to them first for the full breakdown of calculations, and we can take if from there.

    The payouts being referred to are for a successful claim (i.e. you have received benefit from the policy), not if you have already received a partial refund of premiums
    I tell ambulance chasers where to go for a living, but am willing to help genuine claimants

    Hi Katie

    You have only had a refund. This is not the same as making a claim on the poilicy then claiming after. Although saying this Di has said that you may still be able to claim back even if you had made a claim.:confused: Di is looking into this for us so that we will know.

    Katie why did they suddenly cancel the insurance and only refund you such a small a amount.:confused:

  • Wow, you lot are brilliant! Never thought I'd get such helpful responses and so fast, wish I'd thought of coming on here sooner!
    As for making a claim, no I haven't done anything so far, only thing I asked was for them to cancel the ppi then eventually they did it and then refunded some of it. I never asked for anything back as I wasnt aware until a couple of weeks ago that I could try to reclaim my ppi payments!
    So, am I right in thinking I can just go ahead with this by following template letters that Di sent the link to? And Di, have you heard of anyone else with a liv vic loan who reclaimed, and got it back as quick as you?

    Hi there may I suggest you post this on the Bankruptcy thread you have people there who have lots of knowledge and experience and may be able to advise you more appropriately.

    Really hope you get things sorted out for you soon.

    You got for it hun, the chances are this was mis sold to you, and even though this was at a later date I hear these were fined for mis selling this product.;)

    You follow the link I posted to you and keep at them, if you need any more help, just give us a yell.;)

    I have heard of other successess with these, although I cannot recall on the timescales of those, but you should have a good chance here hunni x

    Ive got PPI to start reclaiming from 4 different companies, the first of which is Capital One. Ive been putting it off cause im unsure of the legal wording etc even though ive looked at the template letter for stage 1.
    Ive tried to put it in my own words but would be grateful if someone could take a look and advise me if its ok, my boyfriend has basically been paying PPI for the last 20 years on his 13 loans hes had with lloyds and their credit card plus other credit card companies. The fool had no idea he was paying it or even what it was as nobody had ever explained it to him nor did he ever look at his statement properly to even notice it.

    Anyway are my reasons given for the mis selling valid?

    I opened my credit card account with you on 01 October 2004 and having
    recently looked at the paperwork for my credit card I now realise that I have been paying for payment protection insurance that I did not know I had taken out and until a week ago I had no idea what payment protection actually was or that I was even paying it.
    My girlfriend advised me what it was and immediately on 20February I called and spoke to reference Tom and cancelled it.
    I believe you have miss-sold me this policy when I took out the credit card as it was not explained to me what payment protection was, whether I was actually eligible or even if I would require it.
    I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

    I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.
