    Hi Jessica

I take it the account is no longer active?

In this case apparantely they are not obliged to send the copy of the agreement as they may not any longer hold this actual paperwork as such, but they should still hold details of the account going back the last 6 years at least.

However, its not stating that your unable to make a reclaim, you can still do this, and if you have your loan account number and know you were paying and mis sold ppi, give it a go, I did without my loan agreement - T&C's and was successful.

So you can do this by just completing the reclaim questionnaire as on step 3 below, send to whoever sold you the account, head office or complaints dept and allow 8 weeks for a decision, keep copies for yourself as well, hope this helps and good luck.

Hi Di, No the accout was closed early in 2008. I phoned the bank and got the loan agreement number of them but i guess as you said they wont send paperwork as its not active. Did you ask your bank for a SAR or did you just send of the questionnaire with no paperwork? I dont know if its worth me asking my bank for a SAR as the loan was taken out 7 years ago.

Thanks again - your advice is really helpful to me :)

Hiya Jessica & your very welcome x

I did request a SAR some time ago, but still did not have all the paperwork on the real old cases, but you can of course still make a reclaim with your reasons without having to do the SAR.;)

Hi can anyone help me, I took out a loan with first plus in 2001 for 27.500, paid it off in 2002 but paid off 34.500. I was mis-sold PPI. I have written to them but had a letter back saying time barred. Does this mean I cannot reclaim the money back. I have read lots of the posts on here but don't really understand. Also they have told me it was dealt with by Central Capital who acted as their broker.

    Hi there

What you need to do is, tell them "you have only now became aware of the mis selling where you believe you have the right to make a reclaim" and 6 years time barring will should not be an issue, get back to them.
However, you will need to puruse Central Capital as these were the ones responsible.
Give it a go, let us know how you get on and we can take the next step from there.
Allow 8 weeks for a decision, good luck.

doesnt matter how long ago the loan was taken out jessica the rule of thumb is a sar will go back 6 years but another train of thought suggests you can reclaim for as long back as you have your agreement, personally i had no agreements or paperwork for LTSB did'nt even know my account numbers,i've now won missell on a 16 year old paid up loan and am going to sar the bank tommorow for a credit card agreement going back some 23 years, don't know how far the paperwork will go back but you can but try can't you.:)

My Halifax (HBOS) claim and HSBC claim reached their 8th week today.

Out of curiosity, has anyone else who put claims in on or around 12th May with either of these intitutions received an offer yet?

plus or minus 2 weeks of 12th may say.

And the 31st August will be 16 weeks and 1 day, so they had better send me an offer on the 30th :rotfl::rotfl:

Hi there, you need to find out who the insurer was and put a claim in for mis sell to them..
As your loan was pre january 2005 the FOS will not help you with this as Central Capital would not have been regulated,so cut out the middle man (Central Capital) go straight to the insurer, if the insurers say "get lost" then FOS can help you with this.

This is frontloaded ppi and you were mis sold..

We/I believe we were mis sold the ppi on the above account number.

1)We/I were not told that the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.

    2) We/I were not told that the ppi only covered us for 5 years, but the ppi would still be on the loan to term end with interest.

    3) We/I were told that if we did not make a claim on the ppi ,after 5 years we would recieve the ppi as cashback, and to look on this as savings plan.. But were not told that the ppi would be on the loan to term end with interest and the cashback of ppi would not include the interest that we paid over the 5 years.

In line with the FOS recommendations it is requested that the overall situation be restored as if PPI had never been included.

Use these reasons in your letter to the insurer, also put as Di said that mis sell of ppi has just been brought to your attention, otherwise you would have claimed sooner.
    Please keep us posted.

I put in my claim around 12th April 2011 and got my offer yesterday from HSBC. They had only gone back 6 years and I didnt have any proof that my card was taken out around 2000.

Hi dizzy would it be worth you paying £10.00 to get your hands on the paperwork by sarring the bank after all if you took your card out 10 years ago you could be missing out on a substantial bit of money. this should give you your loan agreement going back to 2000.
