Hi kima you could request the paperwork directly from the bank i've now got details from LTSB of all my accounts going back 18 years,it;s worth a try. they should tell you who underwrote the policy if you can get them to admit what your details are,i think the more claims people put in the more of a pain the banks are going to be but then as we know they don't need a lot of encouragement to be nuisances do they

Did they give your friend a breakdown in writing of the choices?
The bank wrote they were going to settle the complaint in the following manner:
oCalculate a full refund of the PPI premiums that have been paid
oAdd interest charged on the premiums during the term of the loan
oRemove any outstanding payments and interest remaining on the PPI loan.
oTo give you the choice of reducing your monthly repayments (assuming you wish to accept the offer
Via the phone my friend agreed to keep the current monthly payment so that they’d be overpaying the loan to bring down the term, instead of reducing the monthly payments as offered above.
As they cannot take the whole ppi off the loan,give it back to your friend and then take this off the loan balance as well,as your friend would have had this twice.
We understood that the money given to my friend was not to pay back the PPI but for the mistake of the mis-sold policy.
As the loan is still running,if proper redress was given,the ppi monthly amounts paid to date with interest should have gone back to your friend and the whole ppi taken off the loan to reduce the monthly payment by the ppi monthly amountThis was not the case,as your friend got the whole ppi back to them,but should have been told to take the excess ppi (what had not yet been paid back to the loan) back off the loan to reduce the monthly payment.
I totally agree although my friend was given the £5k, at no point in any of the letters were they told to take the £5k and pay it towards the loan. Or the bank to use the money to pay the PPI, taking the loan back down to £20k +interest = £24K.
Can you find out how much longer the loan had to run and what breakdown your friend got after the redress?,as this would help.
The loan was taken out in Nov 2007 for 5yrs and the term runs out Nov 2012.
The amount borrowed was £20 + £5k PPI + interest = £31K.
My friend didn't receive a breakdown, they believed the PPI had been removed as stated in the letter and that the overpayments were helping to bring down the term as confirmed via phone.
Has the loan reduced at all?
This isn’t happening - looking at all of my friend’s loan statements from the beginning of the loan in 2005 to when the PPI should have ben removed in 2009, the overpayments have made no difference in reducing the term. If the loan runs to term, then my friend will have paid the full £31K with the loan ending in Nov 2012
When my friend challenged the bank again as to why the loan is not reflecting the true amount to be paid back or, that whilst they're no longer paying the PPI, the value of it has remained on the loan. My friend got a reply stating that their personal bank and Internet bank will still reflect that they opted for PPI as the branch and system do not alter the records to reflect the changes, but PLSC have updated the records. My friend received statements only to find again that even they clearly state, and as my friend highlighted, the PPI amount still very apparent and evident on the loan.0 -

As a newbie, I can't post links, but if you look at page 937 and post 18736, di3004 being the fab person she is gave me the link yesterday as I might need it too . But she did mention that you need to tweak it.
Read the rest of the posts below it as they offered some useful nuggets to put into it.

I sent off 2 letters on behalf of my brother on 1st June. the first one (RBS) replied to say they needed the policy numbers, I'm trying to get them now. I think they could have found them, but never mind :rotfl:
The other company (Lloyds) haven't replied. Am I right in thinking they have a certain timescale in which to reply? Worried they never got the letter.

They should acknowledge your complaints within a week or 2 of receiving them, then in general have 8 weeks, but they may ask for more time.
Also the FSA have given the main of the banks permission to have extra time.
You could always chase up Lloyds if you have not heard anything at all here.

Di could you get me natalie ceeneys email and hardcopy address for the fos,i'm hearing so much about cap 1 on all the forums i think i will write to her and ask her what she's going to do about the unfair advantage that capital one have over us, also guys if Di posts this up it might be an idea if we get some muscle behind us, so feel free to all have a go as i feel it's going to be the only way to break cap 1's stranglehold over us,what do you all think.

In regards of Natalie I would personally write a hardcopy letter but as you know its best to send by signed for recorded delivery, so you can check the status of delivery via Track and Trace - Royal mail.;)

Do you have any proof at all you were paying PPI?
If you have anything at all to prove this then send them photocopies, but otherwise if you still know for definate you were paying for ppi and you have no paperwork, do as Cappo suggests, take it to the FOS, they will have to send all info to them when the FOS request for it.;)The one and only "Dizzy Di"0 -
Ok just another really silly question, with an HSBC credit card thta started mid '90's, with ppi, would the ppi provider be HSBC or someone else? How would I find out who the provider was, if its not HSBC, as I will need the policy number for the ppi won't I, and that will be different to the card number? Or is it? groan..................
