    Hi Dizzy, you should phone both companies and Cap One to see what is going on, you instructed a claims co and now you end up paying for 2 companies?, dont understand this at all,give FOS a ring and ask if they can help,dont know if they can but it is worth a try.

    Could you post the letter word for word from Cap One?,please as this may help us more.

    The do not disclose part of the letter would apply to you telling anyone about the refund :eek: thats blown it then i would think.:rotfl::rotfl::rotfl:

    Hi - thanks for getting back (sorry its a bit late cant access this at work and have to wait until I get home to reply to eveyone). This was quite an old loan so I suppose that is why they cant find it - it would have been paid off about 4 or 5 years ago I would think. We havent got any paper work on it now either. The loan ran its full term. It was originally a car loan and I am now wondering if he should contact the garage where he bought the car from, do you think that might be a good idea?

    Somehow I cant see my husband ringing them, he hates the phone and I am always the one that sorts everythiing out like that - it would be a great idea though but I doubt that they would talk to me!!

    We dont expect anyone to answer a post right at that moment :D
    We understand people have to work etc so no worries x

    You could write to the garage and ask if they still have the loan details,this is a long shot but may be worth a try?, your hubby then only has to sign it.
    My hubby is the same, dont know what it is about men and talking on the phone :D:D

    I agree, Di......oh, if only I had been a little less enthusiastic with the paper shredder when I was tidying up!!!

    Still kept lots of stuff, but nothing of any use....if only I had known then what paperwork I would need...:(:(:(x

    I would agree there...!! Am about to start on hubby's PPI claims...just know that if I don't do it...it won't happen...!

    But men, in general, are averse to dealing with stuff...phone calls letters...wonder what percentage of this forum is female...?:rotfl::rotfl::rotfl:

    Well yes Amersall thats exactly what I thought with regard to dislosing the letter!!! I have really blown it all now!!! I really dont understand why they would put that.

    I dont actually have the letter from Capital One its from Ashworth Law that is stating what Capital One are staying. Why would they say this? I do wonder if something underhand is going on and I did think earlier about possibly contacting the FOS to see if this is legal.

    I dont honestly remember signing anything with Ashworth Law, in fact I do remember shredding everything I got from them without ever sending anything back to them!!!

    The first paragraph from them states "We are delighted to inform you that your claim against Capital One has been settled for £330.54 inclusive of legal costs. The majority of the refund, £330.54, was credited directly to your card. The settlement reached includes the solicitors costs and disbursements of £55.00. We therefore enclose an invoice of £55.00 for your kind attention Please be aware there is still an outstanding balance of £82.66 to be paid to Consumernet Limited. They will invoice you directly for this amount."

    Consumer Net only rang me late yesterday afternoon to tell me that my claim had not been upheld and they were taking it to the FOS!!!

    I do think they are trying it on but they wont be getting anything out of me until its all sorted out. I will keep you informed.

    I am so confused. I admit that I went through a claims company for a claim against Cap One as I did with First Plus - but this was back in the day when I didnt know how to do it myself!! Anyway I didnt hear from the claims company regarding my claim after a few months so I wrote to Cap One myself, only to get a reply back from them stating that they had written to the claims company, and enclosed a copy of the letter, stating that they had bascially dismissed my claim and if I felt it necessary I should go to the FOS. Anyway I rang the claims company and was told that they had sent the details off to the FOS. Yesterday I got a telephone call from Consumer Net (? not who Cap one wrote to) stating that Cap One had declined my claim and they were sending out a form for me to sign and send back, which they did and I sent it back today. When I got home tonight there was a letter from the claims company (not Consumer Net) stating that Cap One had upheld my claim and £330 had been credited to my account (which basically I was paying of a small amount every month as agreed with Cap One) but there was a condition that Cap One had put in place this is how it is worded
    "Please note that it is a condition of the settlement reached with Capital One that you must not disclose to any third party the fact of, or any details relating to this payment. Failure to comply with this agreement may result in Capital One bringing a separate action against you. Please also be aware that any charges that properly accrue in the future will be applied to your account in line with the published tariff and in accordance with your agreement with them."

    I dont understand this at all, plus the fact that this letter states that I now have to pay Consumer Net and the claims company!! Its all very odd I think. I have had nothing direct from Capital One since the letter stating that they were not upholding my complaint. I am very confused is there anyone out there that could help clarify or advise what to do please?
