I am so confused. I admit that I went through a claims company for a claim against Cap One as I did with First Plus - but this was back in the day when I didnt know how to do it myself!! Anyway I didnt hear from the claims company regarding my claim after a few months so I wrote to Cap One myself, only to get a reply back from them stating that they had written to the claims company, and enclosed a copy of the letter, stating that they had bascially dismissed my claim and if I felt it necessary I should go to the FOS. Anyway I rang the claims company and was told that they had sent the details off to the FOS. Yesterday I got a telephone call from Consumer Net (? not who Cap one wrote to) stating that Cap One had declined my claim and they were sending out a form for me to sign and send back, which they did and I sent it back today. When I got home tonight there was a letter from the claims company (not Consumer Net) stating that Cap One had upheld my claim and £330 had been credited to my account (which basically I was paying of a small amount every month as agreed with Cap One) but there was a condition that Cap One had put in place this is how it is worded
"Please note that it is a condition of the settlement reached with Capital One that you must not disclose to any third party the fact of, or any details relating to this payment. Failure to comply with this agreement may result in Capital One bringing a separate action against you. Please also be aware that any charges that properly accrue in the future will be applied to your account in line with the published tariff and in accordance with your agreement with them."
I dont understand this at all, plus the fact that this letter states that I now have to pay Consumer Net and the claims company!! Its all very odd I think. I have had nothing direct from Capital One since the letter stating that they were not upholding my complaint. I am very confused is there anyone out there that could help clarify or advise what to do please?0 -
I made a claim against egg card for PPI as when I applied for the card there was no option but to take the PPI and a lost card plan. I sent a simple letter outlining the dates and mentioning that I had all of my agreement paperwork. (2002! Glad I'm a hoarder!)
I only sent the letter about 2 weeks ago and 3 days ago I got a refund for £1374! :j :j:j

Hi there, sorry to hear this,they should have found you from address and dob!!, do you have the settlement figure for this? as in your earlier post re Black Horse, you said the settlement date, if you paid this through your bank,is it possible that the account number is there? just a thought.
Failing that your hubby should phone them and dont come off the phone until they "find" him,he should give them the settlement figure,this may help.
Hi - thanks for getting back (sorry its a bit late cant access this at work and have to wait until I get home to reply to eveyone). This was quite an old loan so I suppose that is why they cant find it - it would have been paid off about 4 or 5 years ago I would think. We havent got any paper work on it now either. The loan ran its full term. It was originally a car loan and I am now wondering if he should contact the garage where he bought the car from, do you think that might be a good idea?
Somehow I cant see my husband ringing them, he hates the phone and I am always the one that sorts everythiing out like that - it would be a great idea though but I doubt that they would talk to me!!0 -

Hi Dizzy..this is similar to a situation I had with a claims company and Capital One.
Firstly...when the company stopped trading, I had found this forum and started my own claim...only for Cap One to send a copy of a letter which they had sent to the claims company, saying that they were dismissing my complaint... ( I had never seen it before, the claims company never, ever said anything about it!!)
It all seems to be due to lack of communication, which claims companies are guilty of. If you have engaged a claims company you will have signed a contract, probably on a "no win - no fee" basis ..and this would be the only company you should be paying in the event of a successful reclaim.
I would ring the claims company and ask for a detailed breakdown of all communications between them and the lender,( letter, phone calls, dates etc ) and ask how this other company came to be involved.
It is not fair on you to have to pay out more than once..good luck, fingers crossed...:):)0 -
Hi dizzy i received an identical story from them i contacted the ceo and kicked off a bit, they suddenly found me 3 account numbers but i'm still having a battle royal with them to get my credit card ppi details out of them as they still say i havent got it which is a load of @rap,pester them mightily and be a general pain to them you'll get your details

Yes I fully intend to ring them - its not even as though it was for a large amount. I havent got any money anyway to pay the claims company off - I dont remember signing any documents for the claims company but possibly for Consumer Net - as my husband is on short time working at the moment anyway. So I do need to speak to them asap.0 -

Hi all!
Just wanted to let you all know that I have received a letter from the FOS saying that HBOS are going to make me an offer as a gesture of goodwill!
HBOS will apparently write to me, stating how they will calculate the redress. Then, I need to sign to accept this, and then they can send me a calculation.
I just want to thank everyone on this forum for your continued support, and questions. You've all been a great help! So yeah, thanks!!!
