Welcome to mse,these guys (cap1) seem to do this sort of thing all the time,firstly did you get your acceptance forms back on time and send by recorded delivery? If so you can prove that they got your documents back by the deadline,also if they talked to you on the phone it then becomes an advised sale and theres lots of things they should have told you about namely, t&c's, medical exclusions ,being self employed etc i think capital 1 are caught bang to rights,contact them and tell them that your form was returned on time you should have the paperwork to prove it was delivered on time and you expect them to comply with there earlier ruling or you will contact the fsa, i think with all the problems we've had with this lender we all need to maybe sign some sort of petition.
Thanks for reply and the advice am a bit fed up at the moment as am really strugggling financially and that money would have given me a kick start again will take all advice given and not give up thanks again and the petition sounds like a good idea what they have been doing is theft0 -

I'm sure you'll get it sorted out,It could be something as simple as one department picking it up after a decisions already been made and not realising and giving you another different decision,I'm sure it would'nt be the first time it had happened,don't worry and spoil your weekend,call them monday, I'm sure you'll get a favourable response, they can't change there mind after giving you a decision. (oh and let us know how your getting on with it)0 -
they are not obliged to give you a breakdown of your agreements etc under the consumer credit act if your accounts are closed but they are under the data act you will need to submit a request to your lender for a sar (subject access request)
this will cost you £10.00 which could be postal order or cheque and they are obliged under the data protection act to comply within 40 days.

Thanks very much for your reply. I understand i need to submit a request for a SAR but am a little unsure as to how the information requested within the SAR letter will help me as it doesn't actually give me a copy of the terms of my account with them so how will i actually know whether or not the account had PPI included within it or not?? Are they not obliged to just tell me this information whether the account is closed with them or not - it seems silly to request all of the info within the SAR letter when most of it may not be relevant??
I know you are all way more experienced in this matter than me so i do apologise if i am sounding a little silly!

You could try contacting them first and see if they will enclose any details without the need of a SAR, but a SAR is useful if you've nothing to work on at all, which should at least give details of any loans, credit cards and so on taken out with them, also insurance.

Still waiting for a decision on reclaiming ppi on two Lloyds credit cards. They sent me a letter saying they had recieved my letter and would be dealing with it but it may take up to eight weeks. Its just coming up to seven weeks and I wish they would hurry up because I am experiencing some financial hardship. Its our money in the first place and whats so irritating is if you owe them money you get letters and countless phone calls but getting money from them is like pulling teeth. Grrrrrrrrr!!!!!!!!0

Fingers crossed you will hear very soon, any problems email them as well, even explain about being in hardship if you want to, ask them to consider moving on with it.

Firstly, I apologise if I'm asking ridiculous questions which have already been answered on here...there are so many threads to read, I wouldn't know where to start and I guess everyone's situation is slightly different anyway.
As you can probably guess, I'm new to this but want to start the process of attempting to reclaim a considerable amount of PPI....as I will try to summarise below. Any help or guidance you can give would be hugely appreciated
HFX unsecured (but large) loans - initially taken out (with PPI) in Feb 2001, paid off by consolidation loans (again with HFX and with PPI) in Sept 2001, Apr 2003 & May 2006 and finally settled in early 2010. Can I look to reclaim PPI for all of these loans (although all have different agreements) even though some are over 6 years old? Will this affect any other accounts I may still have with HFX?
BCARD - PPI initially taken out when first obtained the account in 1993. PPI cancelled in late 2010 when I realised I had been paying the ridiculous costs for nearly 18 years (what a complete numpty I am!). Can I claim back to 1993? Still customer to BCARD but now w/o PPI - are they likely to cancel my account if I claim against them?
EGG - similarly to BCARD, but PPI taken out with the account in 2002 and cancelled in late 2010. Can I claim back this far? Still a customer but w/o PPI - are they likely to cancel my account if I claim against them?
There are others (yes I know, can't believe what a mug I have been and how much money I have wasted!) but these are the main ones for now.....

Yes I could try that with Black Horse but if I get anyone like the man I spoke to yesterday, I won't be holding my breath! He was so unhelpful, I could barely hear him and he just sounded like he couldn't care less and didn't want to be there!!
Just a thought if it wasn't for us having been ripped of by their employers these jobsworths wouldn't have a job.
How about thanking them for their help and asking for their name,
once you've got it ,thank them again and let them know you will be including it in your e-mail to their CEO:eek::cool:
