    Hi All

    I am new to all this and only just starting to try and claim on the PPI basis!

    I have written quite a few intial letters to lenders and credit card companies asking for copies of the agreements i have had with them - had my first response today from Citi Financial stating that as my agreement with them has ended they are not obliged to provide me with a copy of the agreement i had with them. I quoted Section 78 (1) of the Consumer Credit Act 1974 (as taken from a template letter on this site) but they state that section 78 (3) (a) states that section 78 (1) does not apply where no sum is, or will or may become payable by the debtor.

    So basically where do i go - i don't have a copy of the original agreement with them so have no clue as to whether or not the agreement had PPI included in it?? I'm sure they are just trying to get rid of me but not sure how to reply?? Any help would be grateful??

    Hi there, you will have to sar them and this will cost you £10, you request all information they have on your accounts with them.

    Call me cynical ;) but i think this is a way of making £10 from each customer as when mis sell first came about people were getting account info for free or £1 even when the loan had finished:D

    Postman called this morning.

    A response from RBS - and an offer as a gesture of goodwill on first claim!

    All PPI payments plus 8%.

    Totals around £1,700

    Number two to get back as well now..

    Hope others here soon from RBS!!!

  • my claim as been with the ombudsman since dec 10 after adjudicator upheld my claim but GE money appealed! guess ive got a longer wait than i thought after reading your post :( Hope u hear some good news soon :)

    Hi are you on any kind of benefit or have got health issues as if you have and of course can provide evidence the fos should look at fast tracking you to the ombudsman,it's a very long wait at the moment as you are aware.

    How funny Di!

    Well as you know, Black Horse upheld my 2 complaints 2 weeks ago and yesterday I got 2 letters from them. I was expecting them to be my cheques, but oh no, they were exactly the same letters as you got!! :(

    Do they even know what they are doing!! I even phoned Black Horse and the man I spoke to wasn't very helpful but said they've received my acceptance and are working out my redress! :(

    Still not heard from Halifax though. I'm very tempted to email CEO of Lloyds on Monday, but dread getting the same lady at Halifax customer services ring me. She sort of makes me feel bad for emailing them about complaints that have been with them since Dec 2010!!

    Sorry your still waiting though, did they say they were paying by cheque or straight into an account of your choice?

    They said I will receive payment and figures within 8 weeks of them receiving my acceptance. I'm guessing it will be by cheque as they haven't got my bank details nor have they asked for them. I reckon they will keep me hanging on until the 8 weeks is almost up. :(

I spoke to Halifax customer services (after another email to the CEO!) about 10 days ago, and they said they still hadn't started dealing with complaints. Do you think I should send another email to the CEO or just be patient? If so any idea what I can write this time? :)

    Lol. I would love to write that Cappo but don't think that will encourage them to deal with my complaints straight away. :D

    8 Weeks is a long time to wait for your own money what is rightfully owed to you, have you tried telling them that you require the money for as soon as possible for personal reasons?
    Not saying it will get them to budge but anything is worth a try.

    To be honest I nagged and nagged a few times a week :o, but it done the trick, keep on and on at them I would. x;)
