    Hi,

First post on this forum and looking for advice if I have any grounds for a claim.

I previously took out a loan for £36k with First National (who later changed to GE Money) in 2004. Not long after taking out the loan I noticed that I was paying PPI and complained that I didnt ask for it.

The company responded by sending me a copy of the signed agreement with the PPI box ticked, I never tick these boxes since I have a very secure job but thought at the time I didnt have a leg to stand on.

Around 2005 my ex wife and I started divorce proceedings and I contacted GE Money as they had told me that all the PPI money was reclaimable (less an pro-rata sums) if the loan was paid off early. I was told I would be entitled to around £5500.

The divorce took some time to complete (2 years) and when we finally got to settlement and I went to reclaim the monies owed, GE Money then stated that they would only repay 7% as it was outside the 36 month window, I argued that we were in the 36 month therefore I managed to get back around £1100 (20%).

I guess my question is, was this acceptable and do I have any grounds for a reclaim for additional funds?

    Regards

    Chrisj
Hi there, was this rebate or ppi mis sell, if the latter then look here for reasons you may have been mis sold and put a claim in.
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#step2
This is frontloaded ppi and you would have had this on the loan with interest to term end.

You can do nothing about the pro rata refund as you will have settled in full and final.
But mis sell is a new claim.

As your loan was pre 05 then you need to find out who the insurer was for your ppi, GE money may know this, then put your claim into them,if you cannot find out who the insurer was then put a claim into GE and they will send your complaint to the insurer.

Can you tell me why a "FORM OF CONSENT" would be with an application for ppi
Not sure, unless that is what you had to sign to say you wanted ppi?.
Could you give us more detail so we can help you more?.

This is what is happening, after the banks were defeayed in the courts, Barclays are paying out on all cases put on hold by the JR.
They have been given more time to deal with all claims to clear the backlog, you may hear something before the time they gave you but just wait and it will get a result one way or another.

is this them, they appear to be brokers?who actually have you got your loan with?

The loan is now paid off I borrowed extra money on my morgage to do so . I PAID 33K and it says to southern pacific., but on my credit file there is something to do with nemo finance.[/QUOTE]
Hi there, Di knows about Nemo, hang fire and she will help you.
What year did you take this loan out?.
It is possible that pacific are the ones that sold you the ppi, and it is them you should put a claim in to.
Not sure on this but Di will help x.

I've had a letter from Capital One (and very kindly enclosing all relevant documentation) basically saying that the PPI wasn't mis-sold, I signed the paperwork knowingly and willingly, and they aren't paying.

Any tips on whether it's worth proceeding and how?

It does not matter if you signed the paperwork knowingly and willingly,
If you did so on the basis on what you were told, then you have been mis-sold. Do remember that Capital One were fined £170.000 by the FSA for dodgy insurance AND they are still at it, you now need to know 100% that you were not mis-sold and as they say they record phone calls, ask for that transcript. I'm afraid that Capital One are back street traders in the banking busines and not a company to deal with, they cannot be trusted. ASK THEM TO PROVE TO YOU THAT THEY DID NOT MIS-SELL THE POLICY ???

They did, they have done it to countless thousands of people, they are overdue another fine from the FSA

Hi hun, left a post about this somewhere.:D;)

Nemo are a lender, and the broker would have been the other.
I did pursue on both of mine though, the first one with the broker and lender nemo for the loan advance as they did set up the advance loan.:) x
