    posted off FOC questionaire to yorkshire bank for loan i had in 1996, got no paperwork, but managed to get loan account number from branch.
    fingers crossed (just been sucsessful with 2 loans from around the same time with lloyds tsb and its the same reasons for mis sale, sent off acceptance letter but still waiting for figures)
    yorkshire bank rang me today to say i havent signed the qustionaire!!!:o:o
    congatulations to anyone who has had good news from banks, good luck to people who are waiting to hear;)

    The loan is now paid off I borrowed extra money on my morgage to do so . I PAID 33K and it says to southern pacific., but on my credit file there is something to do with nemo finance.

    I am at stage 3 with claiming back ppi with welcome Finance. I have been told there are 5 stages does anyone know what they are ?

    Hi there

    Are you making your reclaim through the Financial compensation scheme (FSCS)? as Welcome are in default.

    I made a successful claim through the FSCS over a year ago via another business that went into default, its a matter of completing the claim form, you then send back to the FSCS, they send on to Deloittes who assess your case and will ask you to forward further info if required. (Try to enclose any copies of paperwork you have with the claim form you send).
    Once the case have been assessed by Deloittes, they then move it back on to the FSCS, they check it and if they're happy they will then arrange to send the payment.

    Also check for more details on the FSCS website if you have not done so yet.

    I've had a letter from Capital One (and very kindly enclosing all relevant documentation) basically saying that the PPI wasn't mis-sold, I signed the paperwork knowingly and willingly, and they aren't paying.

    Any tips on whether it's worth proceeding and how?

    If your having trouble in locating them, ring the FOS as a general query, I assume they would have dealt with them, call them in office hours, I'm, sure they will be able to help, good luck.

    Hello there

    So you made a reclaim complaint and they have confirmed they have not mis sold?
    Was this the final decision?
    If so did they mention or give details of the Finanical ombudsman service (FOS)?

    If its not the final decision ask them to reconsider and try to give further details, tell them you do not agree with their decision, give them reasons and ask them to consider your complaint.

    Keep at them until they issue you with a final decision.

    unfortunetly this is always the tack with capital one if the claim is for any significant amount of money they will just tell you it was a non advised sale which lets them off the hook with just about everything every case is different so theres hope yet, but mine is in with the fos at the moment and has been thrown out by the adjudicator and is now going to ombudsman with i think very good reasons for misold,don't let me put you off though as Di says give it a serious go as there all different.

    chances are then the loan is actually with nemo,give the fos a call to confirm and if it is indeed nemo finance who the loan is with this is who you need to chase.

    Hi there

    Just in case I misunderstood.
    With my first loan with Nemo, it was arranged by a broker, so it was the broker I had to pursue on that one.

    I then taken out a loan advance, as we were then lending from Nemo, they provided the loan advance, this one we had complained directly with them, we was eventually successful but resolved by the FOS.

    Even though the agreement will have the lender's name on it, its always whoever set up your loan is responsible.

    Southern Pacific to my knowledge are brokers and not lenders, and Nemo should be able to confirm this to you as well.
    Ask Nemo for the broker's address if they have not yet provided them.
