My question is does "contact you within 10 days" include asking me for the same documentation, for the 4th:mad::mad:, time constitute contacting me??????
Or should I now start stalking the person who said they would take my case up on my behalf?0 -

Hi Di as i said to mrs shazbat i believe it was yesterday, these clowns are hard to pin a case on as all they bleat is non advised,i have heard rumours that the fsa are considering starting to look into non advised sales with a view to banning certainly some of them,i think thats an excellent idea as we should'nt in effect have to sell ourselves policies. I agree with the overnight discussions on these people,something should be done about them as people are sick of cap 1's old cherry, my case is waiting for the ombudsman now,the fos seems to rate cap 1 very highly, i don't know why.0 -

These banks are incredible arn't they,the fsa needs to stop turning the other cheek,i think they were quite gullible thinking that the banks would just roll over and payout, i think by the sound of it they've had enough time now.:)0 -

I was just thinking..... Well a couple of weeks ago Black Horse upheld 2 complaints I had with them. The first loan was paid off early when I took out the second loan. I went into default with my second loan and it got passed on to a Debt Collection Agency, which I am still paying off now. Now here is my thought!... If Black Horse sold my debt to a DCA does that mean they would deduct part of my rebate to pay the DCA and give me the rest or would I get the whole refund? As from what I understand Black Horse would of sold my debt to the DCA for a lower amount (i guess) which means as far as Black Horse are concerned they've been paid off.
Sorry don't understand all this.Hope this isn't too confusing and someone can shed some light on it!
I hope this info isn't misleading boycey but i would think that any money recovered would have to be paid to the dca towards the debt and anything on top would be returned to you of course you could try to negotiate a full and final settlement for the debts you have with the companies you have an ongoing misold ppi reclaim with,i might be wrong on this boycey so guys pick me up on it if i am but i would think thats what would happen. I think now unenforceability isn't so much of an issue we're stuck with the dca's, i think ultimately you would probably have to talk to the lenders you recover from.0 -

So you made a reclaim complaint and they have confirmed they have not mis sold?
Was this the final decision?
If so did they mention or give details of the Finanical ombudsman service (FOS)?
If its not the final decision ask them to reconsider and try to give further details, tell them you do not agree with their decision, give them reasons and ask them to consider your complaint.
Keep at them until they issue you with a final decision.

has yours got to go to the actual ombudsman now or has it got to go to the adjudicator first,mines already been rejected by the adjudicator0 -
I have 2 claims with welcome finnce one before 2005 and 1 after . Ihave a loan with them at the moment. So i know if i will ppi after 2005 if will come of my loan but what about before 2005 direct with welcome will this also come off my loan ???

You may even get all the refunds to you, depends on what the bank decide to do.
But please chase up the refund on the loan that is settled, dont let it go.0 -
Just as a matter of interest citibird has yours been waiting to go into the actual ombudsman now or has it got to go the adjudicator,just as a matter of interest as mines already been rejected by the adjudicator.

apologies for unclear info...my claim is with the adjudicator, and with what has come up in these posts, I have an awful feeling, it won't be good news.

Just one thing...why does Capital One do so well at adjudication..they are clearly rogue traders...and having been fined, it would be reasonable to assume that they might be at a disadvantage with the ombudsman...?:mad:0 -

Hi, now look everyone should understand this especially when dealing with debt collectors.
The lenders sell the debt as a contract to a debt collector, probably at half the value. The Debt collector has purchased the intellectual rights .
Therefore, the debt becomes the debt collectors property and whatever attachments came with the debt
When the debt was sold, it is highly unlikely that the lender told the debt collector that you were claiming the PPI as false selling and the account was under query.
It therefore means that the lender has sold onwards on false pretences to the debt collector.
This is now a very bad time for debt collectors as they are now responsible to you. I advised one debt collector who purchased a so called debt from Capital One, that as they had purchased the intellectual rights, I would be looking at them to refund all false PPI payments. Never heard from them again but I am still hounding Capital One
WHY DID THEY SELL IT AS A DEBT
When I took out the Capital One credit card, it was done on the sole basis that the salesperson was telling me the truth about the PPI,
This then formed a contract. When I claimed, I was told I had no claim.
CONTRACT BROKEN
Despite a realm of letters to Capital One, all I got was fob off letters and then one day, a debt collector informed me that Capital One had sold the contract to them and they now owned it.
Fine, then I am coming after you (the debt collector) for selling me a fruadulent PPI ..... never heard back, I wonder why ??
I have now sent Capital One a severe claim for damages. This is the result of sheer arrogance and ignorance on behalf of Capital One PLUS ... selling me a fraudulent policy, ignoring all my requests and then passing it to debt collectors .... that is straight forward harassment.
My claim for compensation well exceeds any monies they claim are owed
and if any further debt collectors pop up, they will receive a copy of my claim as a counterclaim. It stinks of fraud all along the line with Capital One0
