Hello there
So you made a reclaim complaint and they have confirmed they have not mis sold?
Was this the final decision?
If so did they mention or give details of the Finanical ombudsman service (FOS)?
If its not the final decision ask them to reconsider and try to give further details, tell them you do not agree with their decision, give them reasons and ask them to consider your complaint.
Keep at them until they issue you with a final decision.

Hi Di, Capital One are just rogue traders, they will come up with any excuse not to pay. Personally, I do not rate the final decision rubbish, I mean if we sent a final decision to the banks saying we were not going to pay, they would put the debt collectors in etc etc.
As Capital One have such a bad record of mis-selling products, big fines from the FSA, it would be more prudent to threaten them with county court action saying I will let the judge decide. There own poor track record is enough to persuade any court0 -

I have 2 claims with welcome finnce one before 2005 and 1 after . Ihave a loan with them at the moment. So i know if i will ppi after 2005 if will come of my loan but what about before 2005 direct with welcome will this also come off my loan ???

I think we're all getting the run around at the moment i mistakenly thought it would be easy and straightforward to claim after the judicial review how wrong i was,the lenders are taking extreme liberties at the moment and this looks set to continue,i think the name of the game now is to put as many people off claiming as they can and that's where forums like this are so good as they clearly tell people what there rights are,if you have a case you have been wrongly deprived of your money you are entitled to it back,so stick in there all of you,we'll all get our money in the end.

A forum like this is good as innocent people can see there is a way forward.
BUT, it is only good if they take action and not !!!!! foot around with these banks. They are the ones who stole the money under false pretences and again I shout it from the roof tops,

I was just thinking..... Well a couple of weeks ago Black Horse upheld 2 complaints I had with them. The first loan was paid off early when I took out the second loan. I went into default with my second loan and it got passed on to a Debt Collection Agency, which I am still paying off now. Now here is my thought!... If Black Horse sold my debt to a DCA does that mean they would deduct part of my rebate to pay the DCA and give me the rest or would I get the whole refund? As from what I understand Black Horse would of sold my debt to the DCA for a lower amount (i guess) which means as far as Black Horse are concerned they've been paid off.
Sorry don't understand all this.Hope this isn't too confusing and someone can shed some light on it!

BE VERY STRICT WITH THEM and if need be threaten with court action. The FSA are non too happy with them and they do after all have an operating licence that can be revoked0 -

Interesting. If Blackhorse did sell your debt to a collector, it means the debt collector owns the rights, ie: the contract.
Therefore, the debt collector has purchased the problems attached to the contract and if mis-selling by blackhorse was involved, it is now down the debt collector to settle this with you :rotfl:
I will tell you that debt collectors are currently in big problems with this, they have purchased lots of debts like this and are now finding they are liable to you for the recovery of mis-sold policies.

In first instance write to Welcome to find out the score, but otherwise with them being in default you can contact the Financial compensation scheme (FSCS) that deal with companies that have gone into default where they will direct you.
I am not sure what happens in regards of the refund, it seems to be different from when i made a claim through these, but saying that my loan was settled, so it therefore was refunded directly to me.
The FSCS should be able to answer to your queries, and have you also checked the info on Welcome directly on the FSCS website?
