These banks are incredible arn't they i've the same problem, i was diagnosed with a hole in my heart 36 years ago this eventually caused a stroke in 2009,have put medical reasons for hsbc reclaims, whats the betting they ask for proof of that.It should be no longer relevant should it. I mean anything going back over 5 years really It's a miracle remembering it Let alone having evidence,i still feel that the fsa are letting the banks run rings around them. It should be the banks have to chase this information not the claimants
I concur:D we have all paid our loans/cc/ppi etc and all been mis-sold and im pretty sure none of us have been fined for NOT missing our payments back to these banks or cc companies so one should assume we are correct in raising these questions of being mis-sold and if the bank cant find the information then we shouldnt be the ones to then have to prove ourselves! it should be them! they mis-sold the insurance and how refuse to even refuse to accept we exist Mmmmmm much better now i got that off my chest pmsl:rotfl::D:p Perfer et obdurai dolor hic tibi proderit olim

Hello
I had the same problem . A GE money storecard which now belongs to Santander. They sent me the same letter and I replied last week.
I said the salesperson was responsible in ensuring I understood the terms of PPI, which they did not. At the time of the Account, I was unemployed and had been so for 16 years. As I did not apply for benefits I did not pay NI ( they asked for evidence of contributions) . I contacted the Inland Revenue who told me this information would take a while to process ( Santander gave me 4 weeks ).
I went on to say that as my husband did not sign the agreement how could this be a 'breadwinners' policy, plus he has substantial sickness and redundancy cover so PPI was not appropriate.
I then said I reserved my right to make a complaint to the FOS as I still believe the product was mis -sold.
I sent the letter last week and will let you know when I get a reply.

thank you for your recent letter i understand your complaint is regarding account cover insurance, having checked your account details i can confirm account cover insurance consisting of price, payment and purchase protection was added on the 12th september 1996,when we received your signed credit agreement and opened youir account, due to the ammount of time elapsed i unable to retrieve a copy of this document.
once a customer has decided to take a product a policy summary and policy document is mailed to the customer for their review,we also offer a 30 day no quibble quarantee where the product may be cancelled and any premiums refunded (subject to no claim being made) this allows time to compare the policy to that of any other insurance companies.
in relation to your reference to the sales process in store, there was no requirement unpon us to record the sales process and so we have no way of knowing what took place on the 12th of september 1996 however if any of the matters that you suggest took place, you would of been able to call at any time in the first 30 days and we would of removed the insurance from your account,
i note that you say that you were a full time student at the time of the the policy was sold however this is a bread winner policy and there fore the benefits of the cover would automatically transfer over to your partner providing they were working,if neither your nor your partner were working 16 hours or more per week we will need to see the following proofs
national insurance premiums paid for that year in which you took the insurance out
proof that you and your partner were claiming benefits/job seekers allowance on the date the insurance was taken out
i will leave the case open for a period of four weeks to allow time for you to send these documents otherwise the case will be closed
tania steward
so where do i go from here guys please i was a full time student aged 18 and i had no partner
what evidence could i gather to show them this? i have my college certificates and possibly a student card but im a bit stumped about this now lol
any help would be great thanks
Did you get a student loan, did you sign on for JSA, did you work part time,Who was keeping you when if did not work?.
Sorry for the questions but we can help more if we know what you were doing at the time you got the card.
In my opinion, they need to ask these questions to determine if you were mis sold or not, if you can give them any info this may help your case.0 -
