Hi there, with this being mortgage ppi, you need to post this here ...
as people on there have knowledge of mortgage products.

But please be ready for the answers you may get, as what you have posted here does not sound like a mis sell claim to me as a poor selling technique, i could be wrong but just warning you ;)

Thanks for this - I have posted a more detailed post on the other board as you suggest.
The only other part to this, which I have explained over there, is that when I cancelled the PPI earlier this year, it turned out that I wasn't even covered for the last 5 years due to my circumstances changing, however these circumstances are not covered in the T&Cs and weren't explained when we took the PPI out, so we had no way of knowing that we weren't covered (if you get my drift).

Surely, the fact that it's a mortgage arranged by a IFA shouldn't change things should it?

The original agreement (this will be a copy) may not have ppi ticked, but this does not mean it was not added at a later date, do you have any statements at all that show ppi?.

They cannot say "send us statements to show ppi" and then say in the same letter case closed (unless you have told them you do not have any statements).

If they have said you can take this to FOS, then that is what you should do, as if it is their final say, then you will be wasting your time going any further with them.
A sar maybe in order here if you think they are wrong.

hi amersall thanks for the reply the hsbc letter that arrived this morning reads as follows

thankyou for your letter regarding payment protection insurance i am sorry that you found it necessary to complain. having searched hsbc's records i cannot find any evidence that payment protection insurance was attached to the above product. to enable me to proceed further i would be greatful if you could provide me with documentation confirming the protection held accompanying card statments confirming payments made. i regret therefore that i am unable to investigate your conserns or take any further action at this time and am closing your complaint on our records..

i havent told them i havent got any old statements although im not sure if i have or not and im sure i phoned them when the ppi scandle first came out to stop ppi payments on the credit card so where do i go from here do you think please?

I am not sure about mortgage ppi, sorry, but you will get help on the thread you have posted on, there are IFAs on the thread, so they will be able to give you the help you need.

If you have any statements put another complaint in with copies of these and ask them to look at this again.
As i said if you have no statements then do a SAR.

Yes you may find this online, dont know how far you would be able to go back though, but it is worth a try and will save you £10.

ok dug out some old paper work from hsbc and it appears that i wasnt paying ppi insurance on it i presume that it would be listed on the monthly statements like it is on my abbey credit card which says i was paying 20 pounds a month on ppi

See if any one else posts regarding this gap insurance, you never know if you can claim mis sell for this.

The Black Horse website says it offers optional GAP with particular benefits but is currently reviewing the product so no further information is available. I wonder if it knows something?? Mmm??

Wikipedia says that GAP covers the difference between the depreciated actual cash value of a lost vehicle and the outstanding loan balance on the vehicle. The coverage may also include payment of the physical damage deductible. I take this to mean that it would only make up a shortfall if the vehicle is written off, and would only pay the difference between the amount outstanding and the amount offered by the insurance company if less, if you catch my drift.
I don't know if my son has got any policy documents. Obviously i'll have to ask him to check what it says.

Meanwhile, i'll keep my eye on the BH website

Thanks for your help so far ;)

lucieloo. Just looked back over your posts and it seems you have a complaint against Lloyds of London and they are not anything to do with Lloyds Bank and the BBA. Yours is against the insurer too and I have not seem any real feedback as yet on these complaints although I would think things will be moving soon. There is mention in the new proposals that the FSA made (which was what the BBA JR was apposing I think) about insurers responsiblity in sales and it reads quite complicated. Maybe just getting it all right!!
Hi Marshallka, many thanks for your response. I know that this is a more complicated case its just really difficult to share it with anyone as there are not many who are pursuing the insurer. I am still just sitting tight in the hope i win as i know i was missold a dreaded firstplus loan in 2002. Lloyds of London are denying any involvement in any of it, funny isnt it cause if my hubby had of died during the period of cover im sure i would have had to contact Lloyds of London! Its just a joke but i appreciate your help:)
