Hi there
I am really not sure where you stand from here to be honest, I take it you signed up from the start with the claims company?
Maybe you could contact the FOS who may be able to confirm.
Or meanwhile see what others have to say on these threads.
Wishing you luck on your reclaiming, hope it sorts out soon and thank you for the advice.;)
I'll keep you posted!0 -
Sent the 1st letter asking for £986.00 charges plus interest of £278.70, going back 6 years.
Recived a cheque today for £300.52 "in settlement" nothing requiring my signature accepting the offer, this not enough in my opinion, what do others think? Is this a new tactic? looking through sucesses most seem to get full refunds from Sainsburys.
Court letter next stage in all probabilty
Should I send the cheque back with it?
Should I not mention the cheque?
TIA0 -
Ok Di thanks for the help, i have drafted the same form to Norton stating Nemo hold them responsible i will forward that to them, its a bit like piggy in the middle.0

if the letter did not say "full and final decision" i would send the cheque back and ask them to re-look at the figures as they have got them wrong (assuming you have paid £986 in PPI).
if it is their final decision then send them a letter (without the cheque, but don't cash it) expalining that you are not satisfied with the amount of the refund and would ask them to re-consider based ont he PPI premiums you know you have paid (£968) otherwise you will forward you complaint to the FOS. (this will cost sainsburys £500 if you go to the FOS).
make it clear you want them to re-contract the account as if the ppi had not been there in the first place in line with the FOS guidance.
i think they are trying it on and it may be a tactic to try and limit their liabilitiesI'm proud to say that the banks no longer take money from me after becoming debt free0 -
The final letter dated 15th June 09 said that we had the right to go to the FOS but due to the passage of time since the final response was issued the FOS may decline to look at our complaint, which they did. We are definitely going to try again though as we strongly believe that we could/should have been better advised. Many thanks for your help; I will let you know how we get on.0

Mmmm, a little update here, the wife walked in from work and put her hands on the agreement with Norton, (Nemo were right).
it is their agreement and terms and conditions for PPI, clearly states it is optional,
Statement of demands and needs
1-If you cannot work because of an accident or sickness (we are both entitled to sick pay at work)
2-unemployment cover (we have a seperate cover via the mortgage which is more than the monthly cost)
3-death or critically ill (we both have life and critical illness cover)
it then states
"you have selected to apply for ppi on this basis"
it appears we signed sealed and delivered to them
I think ive just kissed goodbye to around 6k.0
