It was a credit card that I had with Nat West, it was originally an Air Miles credit card but under the Nat West "umbrella" and eventually Air Miles pulled out and it became just Nat West. I dont know how to find out the account number as I paid it off about three years ago, can anyone advise how I can find out. I know I definitely had PPI Insurance on this card for all the years I had it because I vividly remember cancelling it and how difficult it was to cancel it.0 -

i was told by the fos that there is a test case pending about underwritter cases and they are awaiting the results of this. Last time I heard from them they said the results could be expected within 2 months that was mid March so fingers crossed. Mine is with Hamilton assurance0

Oh yes of course, like mine you have one via Hamilton.
I was informed in March that I should receive an update in May, and there will be a delay, they then apologised for this, and said it was a complexed case.
Mine have been with the FOS since around October 2009, so here's hoping for a good result out of this after all that time, good luck on yours too.;)The one and only "Dizzy Di"0 -

I wonder if someone could offer me some advice, please? I had a credit card account with Marks and Spencer which originally started out as a store account but then turned into a "normal" credit card account when they phased those out. Having just looked at my details on CreditExpert, it seems to stretch back to 1994 (which will have been the original storecard no doubt). I paid off the card towards the end of 2010 but know that I was paying PPI for many, many years and have to confess don't recall signing up for it - I certainly never claimed on it. My questions are:-
Would I be eligible to claim and if so, should I simply start off by requesting a copy of my CC agreement and details of what I have paid thus far, using the templates on the MSE site?
If I get the details back from M&S and it looks as though I have a case, do I write to them asking them to consider refunding everything that I had paid up to the point I closed the account?
Is there a time limit on how far the claim might go back?
Thanks very much for reading this and I would certainly appreciate any help or advice anyone can offer.

Hi there,
If you have the account number, you can continue to make a reclaim on the PPI.
There is no harm in trying despite it being sold to you in the 90's, as I am aware there have still be success - even from reclaiming from them etc.
If you do want to request for the agreement (although I am not sure if they will still hold these details), you can just write a simple letter of your own and request they send you a copy of your agreement by 12 days, enclose a £1 cheque or postal order.
Or just continue with the reclaiming, and see if they send you a copy back with a letter anyway.
However, even if they refund for the last 6 years (that's if they do not hold any other data beyond that) is still some success, as it soon adds up, although it would be nice if they still held details going back to 1994.
To make a reclaim:
Complete the reclaim questionnaire - this replaced the template letter on this site, and was issue by the Financial ombudsman service (FOS) to save time later on, so keep a completed copy in case you need to complain to the FOS later on, such as if your not happy with the final outcome.
They have 8 weeks to make a decision, but may ask for more time.

Even though usually you go back the last 6 years, as stated many have still been successful in making reclaims from earlier years.

First - about the judicial review. If the BBA are questioning the FSA's instructions to get them to contact anyone they sold PPI to in the past because they think that is unfair...why are they holding back the claims that have already been made? Is there something else in the judicial review that would let them reject those claims?
Second - my claim is on a credit card I had with Abbey. I now log on through the Santander site but it takes me to MBNA. If my card was with Abbey (now Santander) and Santander aren't putting their PPI claims on hold, why is mine on hold?
I did get a full refund through Tesco :T so thanks MSE.0 -

Right, as you are aware the case was lost for the banks/BBA today as they do not agree with some issues in relation of looking back on past complaints etc, there is however more on the site below to explain more in detail.

Even though the FSA insists banks to now move on with the complaints, it may not be the case now until an appeal is decided, where the BBA have 21 days to decide from now.
That is correct that Santander have continued to investigate complaints, so either contact them about this, or maybe the reason being is because it was sold by Abbey and not Santander, yet its taken over by them, but personally I would contact them and question them on this one.
Hope this explains some matters for now, will be back sometime tomorrow, its been a long day today lol.:D;)

I am somewhat embarrassed to ask the question-and indeed have a sense of guilt;but i had PPI on all of my credit cards.
Unfortunately-following a business failure-i had to declare myself bankrupt (now discharged)
I went bankrupt owing credit card companies money (no-one else-just credit card companies )
Somewhat cheeky and arguably distasteful-but as i understand it-if this ruling is upheld-the credit card companies and banks need to pro-actively contact the 'purchaser of PPI.
Is it likely-having been bankrupt and owing to credit card companies-that they will still need to write to me and possibly offer me a refund-even though i owe them ?
It could be argued that by having PPI (which i never used the 'benefit' of) it added additional interest to my accumulating credit card debt-and had i not had PPI my interest would have been alot lower, my balance outstanding on credit cards reduced and i may just have avoided bankruptcy itself
Any views ?
