  • Hi everyone

    I have send template letters from this site to CITIfinancial whom I had three loans with in the past 6 years for ppi mis-sell
    Loan 1: £5,000
    PPI : £9,40
    Total : £5,940
    Result : On hold due to court case

    Loan 2 : £16,400
    PPI : £1,500
    Total : £17,900
    Result : On hold due to court case

    This one now is my main worry
    Secured loan : £23,200
    (Upfront payments)
    2 years criticall illness: £112
    2 years criticall illness: £195
    Mortgage gurantee : £2500
    Payed the loan after 10months and payed £23600
    Result : £970 Cheque in the letter which says as the insurance was a pay monthly no interest was charged therefore the refund is for all premiums paid.
    Phone them straight away trying to get how they came up with the fugure and was put on hold for 5 minutes and then said ooh we cant get how the figure was calculated but we have requested for the infor to be send to your address and also can't claim back the mortgage gurantee insurance....:(:mad::( I am confused
  • I don't suppose this new ruling will have any effect on my parents case? We followed all the steps a couple of years ago and were basically told, "In 1996 there were no rules to prevent us ripping you off, so we did, tough." The loan was taken out in 1996 and paid off in 2004, they paid thousands in PPI which was no good to either of them AND the guy who sold them the loan said they wouldn't get it if they didn't take the PPI.

    Hiya

    I am unsure on the mortgage guarantee insurance, but I assumed if mis sold, you still have the right to make a reclaim.
    However, I do think Dunstonh will know for definate, you could post on a separate thread about this, but stay within the ppi reclaiming threads, subject it "Mortgage Guarantee insurance reclaim", this way I am sure Dunstonh will not miss this and will give some advice on for you.

    So you have tried making a reclaim and they have rejected this then I take it?

    If not then I would still give it a go, even if they do not have the details going back that far, they could at least consider refunding the last 6 years perhaps, worth a go, but if you have already and been let down, give the FOS a ring and see what they suggest otherwise, good luck.

  • Can anyone give advice on following:
    Took out Secured Personal Loan with above on 06.08.01 and further consolidated loan on 28.03.02 and on both occasions were not given option re PPI. Complained to Welcome in Jan 08 as per Martin Lewis and had letter back saying "I am declining complaint as you have signed the agreeement and dated acknowledging the insurances agreed by you"
    I wrote to Ombudsman in Feb 2008 and was advised this occurred when Welcome was not a member of General Insurance Standards Council (GISC) and therefore not one able to consider.
    Ombudsman wrote to me in March 2009 advising to resend case as may be able to reconsider.
    Response on this occasion was as above but also that "on 14.01.05 as a result of change of legislation the Ombudsman became responsible for complaints against former members of GISC. Welcomes membership started in Feb 03 and as policy sold before this date complaint is not one they are able to consider"
    Does ruling today mean there is any change to this?
    Am in time barred due to the age of this case even though was raised with Ombudsman as recently as 2009.
    Am really fed up as was most definately mis-sold but appear to be nowhere can go with this other than private case through courts.

    It seems like you have been given the runaround on this, so sorry to hear this.
    Even though we got through the first victory today, the banks may go for an appeal and have 21 days to decide on this.
    So basically today's ruling is a matter of past sales of mis selling.

    Maybe it would be a good idea to raise this issue up with the FOS, they should be able to confirm, good luck on this.

    Hi there, you may have to chase the insurer with this. You need to find out who the insurer was and send them a mis sell complaint (the insurer may have been covered by FOS, so ring them and ask) when you get the reply , this may be a "get lost" then you will be able to get FOS to take a look at this.
