    hi,

I was wondering if someone would be knid enough to advise me.

My partner and myself took out a joint loan in 2006.

PPI was included in the loan, it also stated that only the initial named person on the loan was covered for PPI - which happened to be my partner, who was on less money than me.

Is there a possible claim I can proceed with here?

The bank have sent a copy of the original paperwork which states this, and has our signitures.

Secondly, in a seperate case with another bank, I quieried any PPI for another loan, only to be told that the details of that loan cannot be found.

They can see I made loan payments but do not have any specific details of that loan, though they are adamant that there was no PPI.

Would this be another issue, or would it fall under DPA and the loss of my personal data?

Your thoughts would be greatly appreciated on these 2 concerns

    Thanks

    Hi there

There is a comment made in Martins of just the one person being covered, could be worth your while checking it, and its a possible reclaim, its not fair to the other to be left responsible for the chasing for the debt if anything was to happen.

Do you have a joint loan but the insurance is only in one name?
If you’ve checked your paper work and have found that all names responsible for paying back the loan are not covered under the insurance, which is unfair in itself as either could be chased for money if you get behind with payments, and were told or thought that all names were covered, go to the how to reclaim section.

On the other loan, how long ago was it you taken it out and settled it?

They should hold details for the last 6 years at least, you could contact the Information Commissioners Office (ICO) and see what they think.

    Thanks for the quick response

The loan taken did state that only one person was covered - though I still feel the agreement was unfair.

The other loan was more than 6 years ago, though the settlement was in 2006. The bank have stated they have no paperwork for the agreement, though they are adamant there was no PPI

I have also just received news of a £320 refund from Egg for PPI which is a result - thanks MSE!!!

Hi there, if you have proof of the settlement figure and year that you settled, then try sending that in (a copy) with reasons for mis sell, my friend did that on 2 loans settled in 2005 and she was paid up on both. You have nothing to lose.

    Hi there
    Your welcome.

First of all well done on your success!"

And going back to the one settled in 2006, they will or should hold details even its from 2004 which would be the last 6 years, I would contact the Information Commissioners office (ICO) for advice, because if you requested a Subject Access Request (SAR) they must by Data Protect Act (DPA) supply you with the details they still hold on the account and must keep them going back at least the last 6 years.
If you have not done so yet, you can if you want to see what comes back by requesting a SAR, however, you enclose £10 cheque or postal order for this request and they must comply by 40 calendar days, if they are unable to supply anything, they must return your payment alongside with a letter to explain on why they cannot.
A template letter on link below, you can tweak to your requirements if you want to.

Then if any continued probs, contact the ICO from there here.

And challenge that policy as well with your reasons, keep at them, good luck.;)

  • Hi
I took out a loan with PPI in 2006 and was definitely told that my taking the PPI would increase the chances of a successful appication.
I have written to them using the FOS template and received a reply with a request for:
    1. Letter of Complaint
    2. Original Letter of Authority

I thought the FOS was the letter of complaint and I am at a loss as to what the Original Letter of Authority would be.

The loan is still running for a couple of years.

    Thanks in advance

    Hi there

There is a reclaim questionnaire that are used instead of template letters on this site, issued by the FOS, this saves time later, you keep a copy of the questionnaire that you send to the one who is mis sold and set up your account, and you keep the other copy for yourself in case you need to refer to this later on, or make a complaint to the FOS, this saves time later on.

You will find this on stage one of reclaiming, may I ask what template letter you used, so we know what is what in what they are asking for, thanks.;)

    Hi there

It seems your doing everything right, and you should not have to provide anything else.
I would maybe give them a ring or write a letter just to say you have followed the correct procedures in making a reclaim, and just await for their decision.
They have 8 weeks to give a decision.;)

  • Thanks very much for that. I'll give them a call in the morning.
