Yes I agree with Boo, It may be the FOS may need OH permision to carry on complaint but should not have to start over. It sounds like FOS have been in touch and Tesco are just about to do a good will thingy.

    Hi Pinknico, how are you?

Have you any idea of where amersall would stand in regards to the post above?

Thanks hun, I have been going round other sites to see if I can see anything similar, not been lucky yet - unless I missed this, but what do you think?
    Thanks hun X;)

Hello I am good thanks, loving the sunshine. I was not aware that the PPI aspect of the loan is not secured on the property and would proberly want proof of that as FirstPlus are not the easiest of companies. If this is the case then that is good and what amersall says makes good sense.

    Hi hun and thanks.:A ;)

Yes its a super sunny day, sun shining...:T , off to do some shopping shortly.

Yes I agree that FP are hard work, and not the easiest to deal with, if amersall could do this, it would definately be good if this can be done, I do hope so, if this is the case, it will be good for others to know this as well.;)
I'm glad that amersall has also brought this matter up, its something else learnt and will be doing more digging on this, so thanks amersall - your a star, hopefully we will get more answers very soon. X

    Hi amersall

I see what you mean.......and of course I cant' see any reason of why you should not be able to put this ppi amount into a unsecured loan, if this bit is not secured on the property this should be okay from what I can gather from this.
I hope someone can confirm this for you as well hun, I am checking on other sites as well in case anyone else had posted on issues like yours.

But yes I do see what you mean and hope this can be done.;) It should be treated separately anyway from the loan. X
thanks di, i have posted this on fp complaints forum and it does seem that only the loan is secured ,could argue a case for multiple agreements with cca will wait to see outcome from ppi with fos first (admin on fp forum seems to agree he certainly knows his stuff) dont even know where that thought came from just glad i had it:eek: certainly a light bulb moment , thanks to you and pinknico, will keep you posted xx:A
  • Yeah.. its true.. the PPI loan is not secured on the Property ala Firstplus Cases, which as amershall rightly states does in fact add further weight to the whole multiple agreement argument.

It should also be noted that most repo cases do point this fact out and is often instrumental in the removal and refund of PPI.

    Help...

My partner has received a letter today regarding our claim against Tesco PF.
It say's that they have been corresponding with me over the sale of the insurance policy and that as the insurance only covers him any future correspondence will be adressed to him and that if they ultimately pay any sum this will be paid to him solely.

This does not bother us but are they going to make us start the whole process again as it was myself who dealt with it in the first instance and not my partner.

They have sent a copy of this letter to the FOS

The loan was in joint names

You could get your OH to sign an Authority Form, allowing for you to deal with the case.
  • Hi i have a capital one card i can only afford the minimum payments every month but i still pay the PPI on it should i cancel and claim back my money.
  • amersall, if you have your SAR, look for the Consent to Mortgage Form.. Just noted a clause in the Terms, and it states Further Advances, so it may be argued that the PPI was a further advance and that therefore may be covered under the total cost secured.

I will need to investigate more on this.
