Thank you for your reply, I did obtain a sar for our personal account and have successfully reclaimed on two other loans, but will send another regarding the business account which is in my husband's name.
Thanks for your help.

Hiya
Hope your well.;)
May I ask when the final decision was issued on this if you know?
Right I understand they will consider taking on cases if you had some personal reasons that delayed you making the complaint to the fos, for example, illness maybe yourself or someone close in the family that required your attention, or hospital reasons.
Saying that did Lombard actually enclose the final response which enclosed details of the FOS?

Hi Di,
Thanks for your reply.
Lombard offered me a goodwill gesture of £750 on 6th July 2009, but I subsequently found the paperwork some time after. I actually found a previous loan agreement which also had PPI on it from Lombard and they upheld this complaint in full.
Within Lombard's letter it did mention FOS and to contact them within 6 months. The reason I didn't contact them there and then was that a 3rd party was dealing with this complaint/claim on my behalf and they sort of thought that I should take the goodwill gesture. The 3rd party firm however ceased trading and I ended up dealing with the final part on my own.
What do you think? Can I use some personal circumstances to go back to FOS as the reason why I didn't reply straight away?
Thanks again for your help.0 -
Hi All
Found this by way of the internet when I googled Egg PPI.
I've been paying this since may 2004 when I applied for my credit card online (difficult to get this from them but managed in the end!). I can't remember checking/not checking the box. I was a full time PhD student at the time.
Is there any way of getting this back? Sorry for being a little lazy, I will go back and read older posts, just wondering whether any board regulars who are familiar with recent success can give me a heads up.
Many Thanks in advance.0 -

Hi Sparky
I just signed back in now.
I would explain this situation to the FOS and request they reconsider taking on your complaint, tell there was no way you would have known that the company was going to cease so you had to start again in not knowing how this worked (if this was also the case).
Anything you feel that may help.;)

Hi there
Give it a go, I do understand it can be more difficult to have a successful ppi complaint where an application have been taken out online, but yet it can still happen, depending on your reasons.
I am aware that some applications would not allow to move forward online unless you accepted/ticked for the ppi.
For more on reclaiming to the reclaiming questionnaire here:

Hi Paul and welcome
Being sold one of these costly rip off policies is a complaint in itself and you stand a good chance of winning your money back for your reasons.
I take it this was sold and set up by Ocean Finance?
Is so its these you pursue, you complete the reclaiming questionnaire on stage one, send to whoever set this up, keep copies of all you send and receive, in case you need to refer to this at some point.
They have 8 weeks but may ask for more time, please keep us posted and any further help, just give a yell, good luck.
Hi folks,
Thought I would just update you on the progress of my claim and ask for a little more advice.
I have received a letter from Ocean Finance & Mortgages Ltd saying that they are not liable for this policy being sold, as they only began trading in Jan 05. Apparently they acquired the "Ocean Finance" business from Mr P Newey, including certain customer records and the right to use the Ocean Finance trademarks. From Jan 97, they claim that Mr Newey was in business as a sole trader using the Ocean Finance name (originally it was established as a partnership in May 91).
They state that a "novation of obligation" is not recorded in their records, transferring the obligation for my policy from Mr Newey to themselves. They have therefore forwarded a copy of my claim onto Mr Newey and have supplied the address to which they have sent this.
Can somebody please advise over the next course of action I should take please. Do I need to contact Mr Newey striaght away, or wait for him to contact me.
Many thanks

Hi Paul
Thanks for your update,
yes you could ring/write to Mr Newey about this, but maybe it will also be a good idea to also contact the FOS next week in office hours and explain what is what here, they will be able to give advice on your next best direction to take with this, please keep us posted on this, that will be good thank you.

Hi Everybody
Before I start the long haul of reading through all the theads of advice can somebody point me in the right direction please.
My Wife has a loan with Northern Rock, which due to bad money management on our part we are paying back in smaller monthly amounts as we are in a DMP with the CCCS. We have recently found out that my wife has an insurance payment with the Northern Rock as part of the agreement, she cannot remmeber asking for this. The original application for the loan was filled in on line and when it was accepted the agreement papers were sent through for her to sign. I was wondering if we could possibly claim this back? Can somebody point me in the right direction on how to possibly go about doing this.
Many Thanks0
