    I recently wrote a letter via one of the templates on MSE to Lloyds requesting a copy of my original loan agreement. So that I could see details of my PPI contract (not sure if I did that right). I got a letter back Monday with some statements I don’t quite know how to deal with.
    It states:
    I have enclosed with this letter a copy of the reconstituted version of your executed agreement, a copy of your current terms and conditions and a signed statement of your account. By providing you with the documents attached to this letter, we have satisfied our obligation to provide a copy of the executed agreement under section 78. There is no requirement under the Consumer Credit Act (CCA) to provide you with a copy of the original signed agreement. We are endeavouring to locate the copy of you signed agreement but please be assured we would not have opened a credit card account without having sight of a signed agreement. For the avoidance of any doubt, we have set out in the appendix to this letter your rights under section 78.

    (I have read section 78 and right at the bottom and it states that):
    The Cancellation Notices and Copies of Documents) CNCD Regulations then set out the content that may be omitted from or altered in any such “true copy” so, when creating a copy of the relevant executed agreement which must be provided under the CCA, a creditor may exclude, amongst other information, any signature box or signature or date of signature. Since the relevant copy of you executed agreement may be altered as permitted by the CNCD Regulations, it is evident that we are not obliged to provide a “photocopy” of the original signed agreement).
    Now I just don’t know what to do.:eek:
    Now at the end of the letter it says:
    Having satisfied our obligation under section 78, the agreement you have with us is fully enforceable and we shall continue to treat it as such. We will not be entering into any further correspondence with you regarding the provision of copy agreements.
    Can anybody help... please

    Any help would be much appreciated :)

    Hi there, you can put a claim to fortnums and see what they say, you may have to go to the insurer with this one. When fortnums reply they should give you insurers details.Did they say in the letter that they had passed your complaint to fortnums?if they have give fortnums a ring to check they have it, if they have not get a claim in asap.

    Hi there, if you have the copy of the agreement (as stated in their letter to you) then i would put your claim in for mis sell, you have account number so just send a letter saying that you were mis sold this ppi .Look here for reasons that apply to you.

    They dont have to give you the original agreement.

  • Phonecall after phonecall, letter after letter, trying to verify information given out by LloydS staff, I today received my PPI payout of £4800.00. I was told only last week by inept LLoyds Tsb staff, that even though both of my claims had been upheld and the signed paperwork had been received, they would be witholding all payments. B******s.
    So all you peeps out there who are awaiting your payout...don`t lose hope, it sets a precedence that once one is paid others must have to be.

    They haven't passed the details on so I will do that now.
