    Stage 1. Write to the seller

    Contact the company that sold you the policy asking for a refund. In Mar 2010 the banks and the Financial Ombudsman agreed a questionnaire, covering all details on the sale of a policy, that consumers should use to make their initial complaint.
    Not sure who to contact?

    If the seller was acting as an appointed representative of the insurance provider, it will probably tell you to contact the provider instead. Use the address of the branch you visited for your first contact; any follow up can be sent to the head office if necessary.
    It's worth checking whether the company you're contacting was regulated by the FSA at the time of your sale. If either the lender or the seller (broker) were it's best to contact them first as you'll be able to go to the FOS for help further down the line if needed.
    If a company isn't registered you don't need to complete the questionnaire, but it will help ensure you provide the full details of your claim and will be needed if you are able to use the Ombudsman later on, so doing it now could save time.

    Good idea and no worries, you will be okay.
    And remember if you were mis sold its only fair that they should agree to refund you.
    They do not have to take it personal, because maybe the dealer did not have any experience of selling the ppi.

    i have actually filled in the questionnaire and sent it along with my original request to BH direct, do i send it to the local car dealer?

    Did you keep a copy?
    You could send them that, that is fine, write an enclosed letter to explain you did send it to BH, who confirmed its the dealer you pursue, so you enclose the appropriate questionnaire.;)

    Hi again. I've looked into the FLA and the non FOS claim forum here and decided that it would be worse than pointless to go down that road.

    I phoned the FOS and they say that Santander (GE) were not covered by the FSA until December 2001. The advisor then told me that an alternative for me now if I do not want to complain to the FLA would be to go for the underwriter who may have been covered.. To do this I would have to ask Santander who they were and then pass the details of the claim to the FOS. The underwriter would be then given eight weeks to consider the case.

    The FOS advisor was very nice and patient and said that this route should be seen as a long shot but might be the best option for me if I wanted to continue the complaint process but am becoming stressed by it, which I am!!

    I promised myself at the start of this that I would only continue to pursue these claims while they were easy and not preying on my mind. As the Santander one is now doing so (mainly because of the disgustingly insulting and dismissive letter they sent me rejecting the claim, it would have been better for them just to say look, we weren't regulated at the time, so there.) I'm strongly leaning towards just saying 'you know what, I'm done - I have a new life now, free of debt for five years and I don't need to do this to myself over 200 pounds which, let's face it, is long gone.'

    I do think the whole PPI misselling thing is shocking and hope that the above helps someone else though, as without the information on this site (THANK YOU DI3004 :A) I would not have had the courage to even start and would not have successfully reclaimed just over 900 pounds from the Halifax just three weeks after sending the FOS questionnaire in.

    Thanks for sharing your post with us, and we do understand, and of course it can be a lot of stress as well at times.

    Mine have actually been with the FOS a year this month via underwriter/insurer and still ongoing, so its going to take some time, although its been allocated to the adjudcator, so still a long old haul ahead.

    Well done anyway on your Halifax success, that was fab within 3 weeks. Congratulations!:beer:

    Quick update RBS 8 weeks up on the 30th Aug 2010 kept getting the 'still investigating letter' so I have decided to send the second letter yesterday I will have to wait and see now !!!! Kept ringing RBS but just keep getting told it in the pile ??? Studio cards has been with the FOS since Aug 2009. Sill waiting on that one and the adjudicator I had has now left and they can't give me a time scale. I have also decided to bite the bullet and send questionnaire to Yorkshire bank as I had a loan with them many moons ago I got into trouble Iowed 12 grand in the end it went to court and I have been paying it little by little ever since, anyway Marlin Services are now dealing with it and I turns outthe I still owe £9800.00 !!!!!!!!!! OMG so all in all I am still paying PPI ona loan I took out around 13 yrs ago what a mess!!!! Hopefully I will hear from Yorkshire bank soon on that on ? ;)
