UPDATE: I wrote to MBNA, they blew me off, so I wrote to the ombudsman. The decision went in my favour, I had a letter six weeks ago to say if the MBNA hadn't refunded me within 8 weeks to let them know. Predictably the MBNA haven't paid anything yet.

Hi apologies as I have been on holiday for 3 weeks and am now catching up on news here. I was one that accepted an offer from RBS. They offered me refunds for 6 years which was £4,600 as they couldnt find the documentation and so it was a gesture of goodwill. Like many I felt the need to take that but not before ringing the caseworkers and saying I would accept £8k which was still less than the full amount. The person said we cant accept that the bank will only allow us to go with what we have offered. As I needed the money I accepted the offer, in full and final settlemeent. I know better now and am progressing at least 5 other claims through the FOS etc.
I would be really interested if anyone does have success with challenging the 'full and final settlement' as in my experience in work for other things this would be the end of the road - but hey why not, there's nothing lost!:)0 -

Last post was a couple of weeks ago when I was helping a work colleague to reclaim on four PPI claims. One of them was Lloyds - and they have been very quick to send a response saying that they have no trace of my colleague on the system. Bet they wouldn't be saying that if she owed them money!
However, here's the appalling bit - in with that letter was also another letter with the same content to some man that we have never heard of. His address on that letter is given as her address - and all the original paperwork from his solicitor as to why he feels that he has been mis-sold PPI, how it has caused him to go into debt etc. is there too. What does that say about Lloyds' respect for confidentiality? So advice needed on two counts please - what do we do to overcome the bit about no information on the system, and what action do we take about the breach of confidentiality? Would it be worth contacting their CEO for both issues? Any guidance would be much appreciated.0 -

If in the last 6 years they must hold some details of that account.
Have your friend requested for a Subject access request (SAR)?

Thanks Di. She took a consoliation loan out with First Plus and paid all her debts off around 2004. She hasn't asked for a SAR yet because that was just the very first step where we sent the FOS complaint questionnaire. Do you have the e-mail address for their CEO please? Might be worth having a go at him to see if he can liven them up to "find" some information - especially after we highlight their appalling lack of security. I'm sure someone in a previous post experienced something very similar with Lloyds.

I have had problems with MBNA too. They said that I had phoned them to ask for PPI - I responded by telling them that I was out of the country on holiday on the day that they say I phoned them! The last thing I would have been doing is making a call about having PPI put on the account. They refuse to accept this, but admit that they do not have a record of the call, so I've now gone to the FOS.0
