  • thanks for the replys.that was honestly what happened they sent me a letter with card but maybe a should have read it more closely :( ive been lookin at the reclaim £1000s templates for loans and CC so should i use template then change it to my circumstance? RBS are the worst,just received £38 charge for bein £2.84 overdrawn and £10 charge for when i took out money,took money out at 9...wages paid at 1am so charged me for 4hours overdrawn lol ridiculous

    Yes look at the template & pick entries that suit your circumstances. Send your letter recorded delivery & keep a copy, expect your first reply to be go away, & after 8 weeks complain to FOS. As you have probably seen on here some lenders are settling automatically when FOS get involved.

    I am looking at claiming back PPI on my Halifax credit card. I applied inbranch in 2001 with pre-existing medical condition of clinical depression. The lady who did my application asked if I would like payment protection, she said it would be a good idea in case I became unemployed or sick. I said ok-green or what-and that was it. I paid the card off in 2002 but, as you do, started to spend on it again the following year. At the end of 2007 I queried the extra amount (£100) which was being added to my remaining balance each month. I was told over the phone that this was payment protection and it automatically starts again when a card that has been cleared is used again. By this time I was medically retired with chronic condition. PPI has now been cancelled.
    I know I was a twit and didn't check my CC statements but do you think I have a claim? I have read Martin's PPI guide but I'm a bit confused-sorry meds. If I do have a case, do I ask for terms and conditions first or do I plough straight in with a first letter? Also am I just looking at PPI from 2003-2007 or from the time I originally applied for the card? Sorry to sound so dizzy and sorry for all questions.

    Yes use the 1st template letter, once you have received a final response you can then take your complaint to FOS. You may want to ask your bank if you have a buffer limit. Some have it but I'm not sure if they have taken this away now. It was there to allow for you going so much over your overdraft limit. Was not much maybe £15 approx.

    I would explain this to your bank about the charges and ask for them back see what they say, its also worth a try.

    I would defo enquire about the charges if the transaction was done all on the same day eg taken out the funds and wages being paid back in, then how can they charge such a huge amount? Normally if you have not paid anything into the account before 3.30pm this is when charges kick in.

    It sounds like you have a valid claim based upon your medical condition.

    If you ask for a copy of the Terms & Conditions they may well send the current ones, as I have heard of this happening.

    Did you advise the Halifax of your condition at the time of taking out the card?

    It could be that your pre-existing medical would not have covered you at the time, therefore it was a useless PPI product.

    You could ask for a copy of the T & Cs or you could just send the 1st template letter its what ever is easier for you. It may save time for yourself to send the 1st letter.

    Hi there

    I would call FOS if I were you and ask them how you are supposed to get a quote going back to 1994, I would have thought this is something that they should be doing.

    It also sounds like what ever quote you give them they will use the difference between your life cover now and a one that you could of had cheaper in 1994 and refund the difference to you? Not to sure but it sounds like this is what they are going to do.

    I'm currently in the process of trying to figure out whether me or my partner have valid PPI claims. I've looked through the site and there is so much good information but I'm a little confused if I have a valid claim.

    There are three situations that I think could be relevant:
    First is a HSBC Credit Card that I still have but when I first purchased in 2002, PPI was added on. I'll be hoenst I don't remember what I was told about it. It was my first credit card and I'd only lived in the UK for 1 year so had never even had an overdraft before. About a year ago when I was really trying to get my finances under control I noticed this extra charge a month, queried it and cancelled. Would I have a relevant claim for this? I've still got the card but I've recently paid off the balance but haven't cancel it yet, plan to do so though.

    Second is a Royal Bank of Scotland loan that I had. This also had payment protection insurance on it but I once had tried to claim as I had been made redundant but found I was not covered. I thought I was. Probably my own silly fault for not making sure that this was covered but they also told me that because the job I was in had only started 3 months previously I wouldn't be covered anyways. I have recently consolidated my debts and settled this loan but my new loan is also with RBS however does not have PPI. Would I be able to claim for this?

    Thirdly, my partner has a Halifax loan at the minute and we've realised that he is paying a huge amount on PPI. He didn't realise this was an option, and is pretty sure that the agent either told him it was necessary for him to take it out to have the loan accepted or at least didn't give him an option. I have told him to speak to them about cancelling it and see if they allow him. If they do that's great because he'll save. But whether they do or not would he have a valid claim?

    Sorry that's a huge post! But that's why I'm so confused...lots of possiblities to look at :confused: Hopefully someone can help.
