  • ive got a question always read these boards each board and hope yous can help :) i phoned rbs in aug 07 for a debit card as i was taking out contract with t-mobile and they need one to do credit check, the advisor on phone who was in branch said he would send a credit card incase i failed it with debit,he also added PPI without telling me,never asked if i was employed..when i was unemployed in july 08 i contacted rbs credit card line about my PPI but they never done anything about it and have been charged late payment fees when really they should have been covering this with my PPI,Any thoughts new to this ? do i have a case for reclaiming? :)

  • Hi all

First time post, and looking forward to the benefit of your experience...

My wife's had a HSBC credit card since 1999 and we've calculated that she's probably paid the best part of 5k in PPI.

I saw elsewhere (at the beginning of this thread) that there seemed to be some kind of issue concerning when the FSA got involved with this kind of business.

So my question is, would this stop us from reclaiming the PPI?

I'm hoping that the answer is yes as the FSA are regulating this business now and she still has the credit card (and is still paying the PPI, though that will soon stop.)

A an aside...has anyone had any joy with reclaiming PPI on HSBC credit cards...I had a quick look in the success stories forum but couldn't see anything.

    Thanks in advance...

Very strange that they should send you a credit card incase you failed a debit card, I would have thought that if you failed the debit card then you would have failed the credit card too mmmmmmmmm...........

Do you have any paperwork in relation to your credit card?

I definately think you have a case for mis-selling and it is worth fighting for it back.

Remember with PPI if you have ever made a successful claim from it then you cannot claim back the PPI.

HSBC bank was regulated by the FSA on 01/12/01, not sure how the bank was regulated before this time, maybe someone else could answer this. HSBC card protection plan (cardguard) was regulated on 14/01/05 (not sure if this is what your wife has)? Normally if a company was regulated by the FSA at the time of taking out credit etc, then you would be able to take your complaint to FOS if the company did not give a satisfactory response. However I'm not sure who regulated the bank in 1999?

Bearing in mind that your wife has been paying this for approx 10yrs, companies are only obliged to retain info for a period of 6yrs (some do hold onto info for longer than this but not always). Does your wife have any paperwork eg credit agreement?

If you click on the red tab "reclaim thousands" there is a list of mis-selling reasons, if one applies then it is worth the postage to try and re-claim. Remember to send all correspondence Recorded Delivery. The template letters are also there for re-claiming

    Hi Kevin

I agree with dreamer, I think you have a case here for reclaiming and complaining, I would go for it due to your reasons.

There is a template on site but personally I would write on your own words, tell them what you have told us above, and if you will appreciate a refund, plus interest and any charges accurred, they have 8 weeks to respond in full, another maybe required if not successful or until you have exhausted the complaints procedures, they should enclose details/leaflet of the financial ombudsman service (FOS) with their complaints procedures, keep us posted though, in case you require any further help through this.

    Good luck.

(above the page you will see a red box "reclaim £1,000's", click on that, then you should see the part loan insurance, check that out, and fingers crossed.
