Hi Guys,
Sorry for this, I need advice
Took out Loan June 01 with LTSB for £16,000 and had a PPI added for £3369.25 settled in May 02 with another loan £16,300 PPI added £4332 settled in March 2003 with a new loan 24,000 with a PPI of 5,091 settled this in August 2004. Can I make any claims I have all paperwork, supplied recently with a SARS request.
Advice would be appreciated.
Maria
Hi Maria
And yes you can, having the paperwork certainly helps, so for whatever reasons you have for being mis sold, do give it a go, they have 8 weeks in full to respond, and if you were mis sold for the same reasons, keep to the same letter, but remember to write all account numbers that apply.
We have done this and have been successful, LLoyds as well, going back as far as 2001.
More info on reclaiming here:

And ask for help if required, good luck with this.:)

Thanks very much for responding.
SAR's have been sent, Lloyds have aknowledged and promised it will be ready by 11/5/10 so thats good as thats the 3 accounts, no word from MBNA. I was looking at charges originally but why not give the ppi a go, after all had I known what I do now i'd never of gone near it.
Is a telephone agreement sufficient or would there have to be a written agreement for the ppi?
Thanks again.Hello there
Well in my personal opinion, it looks like you have grounds to reclaim, so I would definately give it a go.
It makes no difference if the accounts are settled or still ongoing.
Lots on here have also been successful in reclaiming as from the 1990's and having hold of the agreement will or should help.
Any accounts you have had with the same bank should be enclosed within the SAR, however it may vary on how far back they will go.
I received SAR info going back to the early 2000's and my hubby from the late 90's, so it can vary depending on how lenient the bank is really, and of course some will provide disc recordings where others supply both dics recordings with written transcrips of telephone calls, dates, times, what the conversation entailed and so on, or they will just supply the written transcripts.
If you've not SAR'd yet, here is the letter template with the details here:
http://forums.moneysavingexpert.com/showthread.html?t=1475553
If all the accounts were with the same bank, then one SAR will cover all, so if you also banked with them, you just write your bank account number, and they will send all they hold on you.
If you did not bank with them, write down all the account numbers that you held all the accounts with if you can, but by just writing down the one account number should include all they hold on you.
You enclose £10 postal order or cheque payment, and they have 40 calendar days to comply, and I would also post by recorded delivery for your proof of posting.
In regards then of reclaiming, you can write on the same letter, just as long as the reasons are the same, just write all account numbers that apply to that actual complaint.
More here below of the guidelines of reclaiming, they then have 8 weeks in full to respond, however, do post up for help if required from here, good luck and please keep us posted.;)

Anything you have should be a help, so with it being a telephone agreement, hopefully they will send you a copy of the phone recordings, or at least the written transcripts of the calls which includes the sale.
Normally you would have to agree to PPI on a signed written agreement, so this may also go in your favour.;)
I would chase MBNA up if time is running on.
Good luck. The one and only "Dizzy Di"0 -

Ive got a few questions i'd like to ask if somebody wouldnt mind answering.
I have 4 accounts which I want to try and claim back.
I have sent both SARs as there is other things I want to check also(say both as 3 are with the same bank).
Will this include all information on the ppi/call transcripts, t&c etc?.
There is 1 account where I have a copy of the original agreement from 1998(my 18th b day). It was pre filled and I just signed it, all I remember was I went in for a meeting with the manager where I was given a debit card and a few other naff insurances and despite not wanting 1 I was persuaded to have a credit card so signed the agreement. Now it has had the ppi box ticked, the limit was £500 which was less than a months wage so no way i'd of asked for it. Can I reclaim this far back?, I have since cancelled but tbh didnt remember having it till I recieved my agreement on an s78 request. Card is still in use.
Also another account opened in 2003, I was called about a month after opening the card and sold some ppi. I cant remember what was said but I was an asthmatic which I imagine I would of mentioned and ofcourse this would of voided any related claims + again the limit was very low so I doubt it was in my interest. Now the other thing with this 1 was that I went self employed in 2005 and paid up till early 2009. It may of been ok when taken out but I had never been told it would probably not of paid out to a self employed person so didnt even consider telling them. Any grounds here to reclaim and will I get the transcript of the sale call and original t&c in the SAR?
Then the other 2 were loans taken out in branch both with PPI, told I had to have it because of my age and the fact I had only been in my job 9 months. These were taken in 2003 then redone up in 2004. I dont remember what was refunded from the first but no doubt something wont add up there.
Sorry to waffle, any advice on whether a I can claim this far back and b whether I have a case would be much appreciated
I realised in 2007 that there was PPI on my credit card and stopped it immediately. After being refused a refund by the bank I took it to the FOS. It is now coming to the end of its journey with my case being now with an actual Ombudsman. If my claim is upheld, it will require a refund from the bank going back to 1987.
Don't ever give up because the banks rely on those who do. If you think you have a right to claim then do so.
Good luck.0 -
hi there, i would think you will have an agreement in writing, you cannot get ppi over the phone, if you did it on the phone (talking to someone about this) you will still have paperwork
In that case there must of been something sent out(dont remember) but guess if there never was anything signed thats game over then?
100% remember being called and discussing it as the lady was very nice and was actually flirting(good salesperson me thinks) and I was in a rush so just said yes.
