    Hi there

    I would in your case give the Financial ombudsman service (FOS) a ring, and see what they have to say about this, if its only now recently you realised you were mis sold the PPI, you may still have the chance, so give them a call and see what they have to say, if this is the case the FOS could write to them again on your behalf, you can ask them to do this for you, its worth a shot.

    I understand many on here have still been successful in reclaiming from the 1990's.

    hi there,sent letter recorded and got letter bk within the week with offer, however sent further letter in regarding 2 others and still waiting to see what happens 4 wk later,, i suppose it depends who lookin at it and if there idol or not

    So although you've had an offer (which is great) you've not had the money back yet? :(
    Did you find their offer acceptable or was it lower?
    I am posting off a letter today regarding 2 loans, I just phoned to get the settlement figures for the loans and they have given me totals but couldn't give me a breakdown. The gent I spoke to asked if I would be writing in about them and I said yes, so he said they would be looked at and the PPI worked out then. :T
    Off to Post Office to send the letter recorded delivery, will update this when I get a response.:)
  • I got a car loan in 2003 with black horse who made me take out PPI as a condition of giving me the loan, at least thats what the sales guy at the Ford garage told me. I tried to claim last year with the standard letter but Black Horse told me to get lost twice. The garage I originally got the car from is no longer trading. Is it worth me trying again with Black Horse or not?

    I recieved the final response today
    they say they are not liable for any allegation as they were not present at the point of sale and did not sell PPI covering my agreement and the dealership that was has ceased trading. they keep telling me to provide documentart evidence that the ppi was misold and send it to them to investigate, which is a contridiction in terms, why say they are not liable for any allegations but then tell me to send proof to investigate!?

    They state that this letter is there final response and I should take it to the Ombudsman if im still dissatisfied.

    So how do I contact the ombudsman and what do i tell them, I don't have any documentary evidence I just know the car salesguy told me I wouldn't get the loan for the car if I didn't take out the Gold cover - how do I prove this???

    Any help please - has anyone else had the same problem with Black Horse?
    I need to start saving so I plan to save £2 a week to start with:beer:

    Sorry to hear this, but what they mean by the seems of it is that they are no longer looking into this so you can now move this on to the Financial ombudsman service (FOS) to ask them to investigate your complaint.

    You can do this by either ringing them, ask them to send you the form by post or you can download and print a complaints form from their website, and also enclose any copies of final letters/correspondence you received from the loan company.

    providing you have genuine reasons for a miss-sale there is no reason why you can't go back a number of years, for example, i have gone back back 10 years with Barclaycard and been succesful, some on this site have gone back further.

    the only drawback to going a long way back is wether or not there is adequate information on what the premiums were and proof there was ppi added if you can't get a copy of the loan agreement and bank don't have one.

    Thanks for the advise. I'm still waiting for Lloyds to get back to me with a response to the SAR. I was just a bit concerned that they may try to get out of it.
    I cancelled the PPI back in 2005, when I finally found out it was being taken out, it was probably added to my credit cards some time between 1997 and 2001 - but at the time I was at Uni/ out of the country and wasn't paying my own credit cards (my Dad was dealing with it for me and for the most part only paying the minimums). I only have records from 2001, that I found fairly recently.
    I didn't even ask for Payment insurance, as I was a student when I got my credit cards. I knew back then that it wouldn't apply to me. I am pretty sure that initially they asked me, and I declined stating the reasons. I am also pretty sure it wasn't on the cards in the first year (I had paid off the cards initially with savings but they had had a bit of debt on them over a number of months), but after that I wasn't even checking them (silly I know).
    I guess my biggest fear is that they won't give me the money back, since I cancelled it back in 2005 and was unaware you could possibly get it back until recently (I was irate on the phone from what I recall saying I hadn't asked for it in the first place). I should have really been checking my statements back then (I check absolutely everything now), but was kind of living under a rock a bit following an accident.
    Do you think I have anything to worry about, or do you think I have a good case?

    Well I certainly think you have a good case with the reasons you have, if they don't uphold in your favour when you do get to make a reclaim by the final decision then complain to the financial ombudsman service (FOS) who I'm sure will see this in your favour, good luck.;)

    Hi Again this is a bit of a long ask but here goes. A while bacK we started to claim ppi back on a credit card we took out on an alliance and leicester credit card back in 1996 we claimed on pre-exsisting medical condition. The credit card was switched in 2003 to mbna by A&L. We sent the first letter to A&L but the response back was sorry but they were no longer responsible write to mbna which we did and were refunded by them all premiums dating back to 2003, but they said We should get back in touch with A&L for premiums before that. So I wrote back to A & L 8 weeks ago and have heard nothing back. Do you think I have a case for the rest of the premium or should I just cut an run with what mbna refunded us. It seems unfair when A & L sold us it in the first place.????

    Sorry to hear your being messed about with this one.

    I would personally contact the FOS and see what they have to say, maybe they will also write on your behalf if you ask them, they should do this for you.

  • Hello, please help me if you can

    I did a stupid thing and asked a claim handler if they could help me find out if I was entitled to any refund on my loan, I had already cancelled my ppI but they found I had loan care on the loan too, so they asked me to sign a form so they could begin getting the money back from the bank but i did not sign this agreement and claimed the money back myself but now i have the claims handler asking for their 25% fee.
    DO I HAVE TO PAY THE HANDLING FEE even though they didn't do the claiming??
