    HI,

Just a quick update, I have received a letter from loans.co.uk in response to my initial letter requesting my ppi.

"thank you for your recent letter.
We are currently investigating your complaint and we aim to have a respose within 28 days.
I have enclosed a copy of our internal complaint procedure leaflet for your infomation. I have also enclosed an authority form, please can you complete and return to us as soon as possible.

    yours"

I'm a bit concerened as this is not what I expected. the authority form asks me for the details of the lender, which is GE Money, they then say they do not hold any current info in relation to my finance or ppi policy arrangement and that they require my permission to request further infomation from them. Without my consent they will not be able to fully investigate my complaint.

Now when I spoke to GE money they passed me to loans.co.uk saying pretty much the same thing, feels like I'm getting the run around and do not know what my next step is.

The form goes on to ask me 'is the loan still active and if not when was it repaid' well, I know that, No and October 2005. It then asks if my ppi policy is still active, No, and if no, when did I cancel the policy?
That is the question that has me stumped. I didn't even know I had PPI so I have not cancelled anything, the loan was paid off in 2005 and as it was sold as a single premium, I have found out recently that part of the settlement was the full PPI amount, which was for 5 years in the 15 year loan. Sorry if that's confusing.
Do I answer, october 2005 because that's when the loan was settled, do I answer I did not cancel becasue I did not know I have, do I say Nov 2009 as that is the lifetime of the PPI ???

Just for one other spanner in the works, if they say ppi was justified and 5 years covered me from nov 04 - 09, where would I stand on a backdated claim for loss of earnings as in July 2008 I collapsed with clots in my brain and could not work for the best part of a year. Now I did not claim PPI because I did not know I had it. Would that argument, supported by letters from my employer detailing my absense and from the hospital detailing my condition, allow me to make a post dated claim, because if so, a years salary for me is way higher than the £5.4k PPi claim.

    Thanks again

Please, if anyone can decypher this, can someone please give some advice???

hi there and sorry to hear about your clots, are you well now? i would go down that angle of you didnt claim because etc. are you sure if you put a backdated claim in that they would pay your salary ?or is it just the loan payment? if it is just to repay the loan then you would be better off with a mis sell claim as you get back all you have paid with interest plus the 8%. i think you have a good case for mis sell. just put, how could you cancel this when you did not know you had it. hope this helps xx just realised this is paid off you will get the full amount of original ppi back plus interest, i think that will be a lot more than 5000?

Thank you for your advice, I hope you are right. I't s quite nerve wrecking.
RE the clots, no, they are still there, and I have to be on medication the rest of my life to stop others forming. Doctors have no explanation of how they started, I came off the tablets for a couple of months as they thought I was ok but then I was hit with another 5 in the brain and one in the lung. Just came out of the blue with no history at all. But hey, just have to get on with things I suppose.

  • A result of sorts.

Back in August 09 I started the process of sending letters of complaint, using the templates, to Lloyds TSB regarding the misselling of PPI on a loan I took out with them and which was subsequently paid off in Jan 09. At the time I was told unless I took the 'Optional' insurance I would be turned down for the loan and this was the basis for my complaint against them. Of course Lloyds TSB rejected my complaint and letters went back and forth and this took me til Feb 2010. So It was then recommended by you good people on this forum that I go straight to the FOS so I did. An adjudicator wrote back to me last week to say that they are upholding my complaint and recommending that Lloyds TSB make a settlement to me and that they should also pay £200 in compensation for distress and inconvenience! Hurray I thought!! But of course Lloyds TSB are ignoring them so now my case will have to be reviewed for a final decision by an Ombudsman! Grrr!! I am pleased to have been listened to finally and have someone in agreement with me, but frustrated that Lloyds TSB are dragging it out in the hope that the review brings a different verdict!

So what do you think the chances are that I will actually get the settlement? I am aware due to large volumes of complaints that it will be a while before the complaint is resolved.

Have to say thanks to the support from the forum, I would have given up ages ago without it!

    Hi there

This also happened with my hubby, his complaint went into the FOS via LLOYDS TSB Credit Card PPI in 2008, it was upheld in his favour but LLoyds ignored the decision in earlier in 2009, it was then moved on to the ombudsman himself who also agreed with the adjudicators decision.
I think you will find the ombudsman will also rule in your favour, its rare it goes the other way.
It may take some time, if your in hardship though let them know and they should consider moving it on quicker for you.

    Good luck with this.;)
