Compensation isn't and shouldn't be 'reserved' for serious injuries. It is awarded on a sliding scale - no loss of earnings and no lasting damages, then the award will be very low.
And this is EXACTLY what is wrong with this country!!
Claiming out of pocket expenses if fair (loss of earnings, replacing damaged goods etc...), but claiming compensation SHOULD be reserved for those who have suffered a severe alteration to their lifestyle.
My post was a combination of personal opinion AND advice: My advise was not to bother claiming compensation. A new shower door, delivered and fitted at their convenience would be suitable.Should've = Should HAVE (not 'of')

i am not saying that i should claim compensation i am not that "type" if thats what people are refering to, my husband is in business and we get it all the time what i dont want is it happen to anybody else, what my point is that i have been totally frightened what could of happened as the company should of contacted me 2 months ago as thats when the brackets were in recall.
ITS NOT ABOUT THE MONEY ITS ABOUT THE PRINCIPLE AND THE PRINCIPLE IS TAHT THE PRODUCT SHOULD OF BEEN RECALLED 2/3 MONTHS AGO!!!!

As I have previously said, compensation should be reserved for those who have perhaps lost a limb (landmine) or braindamaged (starved of oxygen at birth).
Yes, it was frightening, yes you had a few minor cuts, but the main point is that you are fine, no damage is done, and you'll be getting a new shower door.
You should always think of those more unfortunate than yourself before going down the compensation route, as it is a very selfish thing to do.
Can i just say i'm far from selfish do you have any children? i was asking advice as i've never been in a situation like this before and my children are the most prescious thing to me, the company had a recall on the brackets and not notified me its not about injury i'm not piling anything on just what could of been and what the company should of done as my kids were in bath on that night earlier......... its negligence.... no....... thats whats wrong with this country no responsibility. I just want the matter resloving, my bathroom restored and i'm still hoping the company will do this at least, but i sit and wait.0 -

there apparantly has been a recall on the brackets over 2/3 months ago and they did not notify us hence the request for advice, not sure what they offering i have contacted them but awaiting there response.

there was damage done, i never said we were getting a new shower door very persuming, but thanks for the advice...... not....... never persume anything!!!! this contry should learn from that at least.0 -

The problem with the compensarion culture is those who exaggerate injuries to gain unfair payouts.
If someone has been shown/proved to be negligent and injuries result,then if for no other reason than to send a clear message that negligence is unnacceptable, compensation should be claimed and paid.0 -
There is no "entitlement" to compensation - it's not a case of "if you qualify, you get it".
It's all about negotiation and the threat of legal action. So all you have to do is build up your evidence and case for compo. Don't refer to what could have happened - state what did happen and what the result was, only.
You say you're being advised to sue - that means going straight to Court. Who's advising this?Warning ..... I'm a peri-menopausal axe-wielding maniac0 -

who doesn't know the full story, wouln't have that layed back approach if it happened to them.
and that is not an exaggaration, they, and i could of been killed be a company's negligence, as the brackets had been recalled and i had not been notified .... and that is the point.0 -
