British Gas Threats (Please Help)

    It turns out that BG declined me to take over the supply because of the debt that was on my mums account.

    BG have now said, that the reason why I was declined was because they recieved the letter of bankruptcy after I applied to change to Swalec.

    As to date, BG say my mum owes quite a large amount and has to be paid before I can takeover with Swalec.

    Looking back over this thread, it seems clear why BG would refuse to let your mother switch - under the impression that you had taken over the account, your mother has still not entered into and kept to a payment arrangement. Or has she done this now?

    She needs to repay the debt - how much has she paid since you posted last month? Has she set up a regular payment plan? Would prepay meters be an option here?
  • She has not paid anything, as its in dispute... She was advised to do this by someone in BG.

    We were told to wait 10 days, been trying to sort this out for weeks...

    Probably best I get a solictor involved, its very complicated.

    Personally I don't see how my mother is responsible for the debt, when she didn't even know they were still supplying at the property to this day...

    My mums argument with BG, what right did they have to decline me to take over the supply, when there is no reason for me to be declined. Had my mum known that they were still supplying, she would had paid the outstanding balance owed after the bankruptcy took place and initated the switch over with Swalec to my name.

    I thought this was covered earlier in the thread.

    Surely you can see that BG have the right to refuse to transfer accounts that are in debt to another person?

    For example:

    I run up a £500 debt with a Utility company - I can't pay it so I transfer the account to my wife. They can whistle for the £500 or I go bankrupt.

    My wife runs up a £500 debt, she can't pay it so transfers the account to my son. They can whistle for the £500 or she goes bankrupt.

    My son passes account to daughter etc etc.

    Despite the complication with Swalec is that not the same situation with your mother? She owes BG and until that debt is cleared they are not going to allow you to take over the account?

    Unless I have misunderstood something, I can't see what your complaint is!

    I'm not sure you doing so will help you much, but in any event you must first go through the correct procedure. i.e. to make an official complaint to your supplier and allow them up to 8 weeks to investigate & respond (or otherwise be in receipt of a 'deadlock' letter from your supplier)

    I don't think you've done this have you?

    Failure to do so will simply result in your dispute to the ombudsman being rejected.

    Who is responsible for the debt then?

    What do you imagine a solicitor will say?

    I'm sorry to say that as the account is still in your Mums name the bill will have to be paid. Giving BG all the money refunded by Swalec would be a start but I think as it has gone on this length of time payment in full will be needed or a Prepayment meter will be fitted on Warrant. Do you and your Mother have the same surname? It may also be that when you applied to take over the supply it raised suspicions.

    I cannot see the Ombudsman taking any different view. Your best bet would be to get a loan if needed to cover the bill and then you would be allowed to change suppliers.

    You say you were being supplied by two companies- you were not. You were being supplied by one - British Gas- and billed by two. Unfortunately Swalec made a mistake but they have refunded you so you should be no worse off if you pay BG the money plus the £200 your Mum previously owed. Of course there will probably also be charges incurred. Possibly a deal can be made with these because of the mix up. I work in BG.

    So if she had known she would have paid it, so you are implying she had the means to pay it but didn't bother as she thought the supply was in your name now ?
