British Gas Threats (Please Help)

I need serious legal help with this, because this is not going away and it stressing us out.

My mum went bankrupt. My mum owes British Gas X amount for the debt occured after bankruptcy (fair enough, that will be paid over time).

But the problem is now, the electricity supply is in my name (the son) and I am with a totally different supplier. Yet British gas are threatening to cut this supply off by sending letters to my mum, even though my policy is NOT even with them.

They are using words like Locksmiths will drill your keyhole, Warrant of Entry, Police present.

How can they do this? From my understanding, if they do come and fiddle with my supply, they are breaking the law?

We have called humpy times, explaining the situation, but the letters still keep coming. What can I do??

    To clarify: BG are persuing your mother for a debt incurred after she was made bankrupt and she doesn't dispute it. Has she negotiated how she will settle this outstanding amount?

    I don't know where you stand with the disconnection but I would have thought the best way out of this situation was to arrange settlement of the debt.
  • Hi, yes the debt will be settled.

    But thats not the problem right now, they are threatening to cut MY electricity off, even though I have nothing to do with them or my mother.

    I pay my supplier every month on time.

    legally I don't think they can

    obviously the debt will be repaid, but in theory this has nothing to do with me !!!

    If the supply is now in your name and the supply is with a different supplier they cannot disconnect you. The issue lies as I presume its the same surname.

    Ensure 100% the supply is with another supplier. Ensure your Mum has an arrangement with BGAS on the debt. Ensure you call BGAS to tell them your Mums account is closed and with you from X date and the date you moved suppliers.

    Its odd as usually when your in debt suppliers dont usually let you leave for another supplier, unless they didnt object to the account leaving.

    Also if it goes to a warrant, go to Court and explain. Majority of warrants are granted as no one usually turns up from the customer side. However Magistrates are reluctant to when customers show up to defend theirselves against warrants of entry.

    Course they can, if you dont pay for the service they remove the meter. The only cases where they don't disconnect are domestic where it is encourgaed to fit pre payment meters. Please note encouraged, if youve been fiddling with the meter it may come straight out.
    Or in the case of vunerbale or young children in the property its definatley a no no on disconnection.

    If your a business customer your fair game for disconnection.

    We have done many times and ALL times they say they understand, but yet the letters are coming and threats are worsening. 100% the supplier is different, I am with Swalec now under my name... I am the son keep in mind, my mum was the bankrupter.

    I think it is the problem. If your mother negotiated settling the debt, and kept to it, you wouldn't be dealing with this.

    Sorry, but i think your getting confused.

    Please re-read my posts. I am not entitled to pay my mothers debts.

    And surely they cannot switch MY supply off, I do not owe BG a penny.

    Calm down dear. Not saying you must pay your mother's debts, just saying she should.

    It would seem that you will not be disconnected because you are now responsible for the account but that you may have to go to court to explain this.

    I was merely pointing out that if your mother negotiated settling the debt, BG wouldn't be taking her to court. And that would solve your problem of the threat of disconnection.
