The xbox's were scanning at £97.93 when I checked on Monday.

You sound surprised. I've got a manager locally who agrees that something is misleading and took the offending item off display yet refused to R&R the goods on the basis that I was charged the SEL price. This is all in the same breath as saying that the material he took off display was misleading - dooooh! When it's pointed out to him that the store is in breach of the Price Marking Order and is also breaking the law (CPA breach) by charging the higher of two prices displayed, he gets even dumber and seems to know nothing of standard retail law.

Hey, if they can't do simple math, what hope have we got expecting them to have a broad understanding of the Consumer Protection Act or other laws that they should be more than aware of in their roles?

The policy has been around for years - at least 3 years to my knowledge as I remember my wife returning with a present for me before we moved out of an area (3 years ago) exclaiming that she'd got it for free becuase they'd overcharged her at the till and she didn't notice until after.

An observation on the FRESH Meat pricing i.e. those items which are variable weight and the main comparison is Price per Kg......

If you check the bar code out on the packet - ignore the last digit then work your way to the left you will see the price you're being charged. As that is calculated from the weight on the packet and the price on the packet then that will be the correct price.

If the pack price per kg is lower then the SEL then there's not a lot of point in picking it up as it will go through as the pack price.

NOTE - this is for variable price items only.....things like the Turkey Joints in foil and Duck Legs which are a "set price" could still go either way.
