Child Maintenance (CSA) questions (merged)

    The child for whom, the CSA has been claimed is in the army earning a sizeable amount of money. The money is still going out of the wage packet. i cannot believe that the PRC is still eligible as the son isn't with her and lives independently. If the CSA automatically stops along with the child benefit then where has all the money for the last year plus gone? How does this system work?

  • Apparently there are only two other courts in the country who are also refusing to action warrants, one in cornwall and I can't remember where else. Unfortunatley it's not just the CSA saying this. They told me that at the moment they have 13 other cases which have all had warrants issued but no action has been taken. They are currently in the process of getting the courts to allow the CSA's own bailiffs to action the warrants. They also told me that if nothing is sorted out soon then I should contact my mp!!!!As this might make the courts do something!
    I will look into complaining as it never made any sense to me that even though other arrears where mounting up they still didn't put them on another charge they just let them add up and then he sold his house so they couldn't put them on!

    The commitals team of the csa seem to be quite good. They do what they say they are going to do and they always ring back! Just live in the wrong area by the seems of it!

    He owes £1000's but I don't think I've much chance of getting it as he doesn't even bother seeing his daughter even though he's only a mile away. Doesn't even speak to her in the street!

    No wonder you are fuming. I would definitely take this up with your MP and it would be worth your MP's while to contact the other MPs involved.

    Why won't they put a charging order on his house ( I don't know details of your case )? I presume he is not renting. Then they could go for an order of sale?

    Perhaps the PWC is not getting the money, have you any arrears outstanding? if so this will still have to be recovered. Do not automatically assume the PWC is the person with fault here ;)

    Have you tried calling the CSA and asking them why this is still happening.

    Yes Zara is right. If there is any money outstanding, it will still have to be paid. In some cases, maintenance arrears can be paid many, many years after the child has grown up. Do you have an account or any idea how much is outstanding?

    WHAT???? The CSA will have to pay the standard court fees anyway, just like they do for a liability order. The fees are then added on to the arrears. Have you got this confirmed by the court or is this the CSA talking?

    EDIT: I was told that given the NRP is self employed there is little point in sending them to jail, because, although the arrears remain there on paper they are deemed uncollectable...UNLESS...the NRP becomes salaried later on. And the NRP is not going to do that!


    This isn't true. They are only uncollectable for the period that they are in jail. When they are out again, they are collectable again. They can return to other enforcement action at a later date, even if they have been to jail. So, if they buy a house, a charging order can be put on after he has been to jail, and then an order for sale made, or they can send the bailiffs in again.

    Unless the money being taken is for arrears, in which case it will continue to be collected until the amount outstanding has all been paid up.
