  • I have done this as he doesnt have a licence either , police pull him take him to court give a fine and he is back on the road again.It Doesnt stop him and he gets away with it,I used to drop my son off and pick him back up because of this reason now ive stopped it as im wanting him to take responsabilty. thats why im i need advice as im sure hes gunna get out from paying for his son and the csa are going to allow it.Its so annoying that law abiding people take all the grief and people like him get away with everything.I dont know what to do

    It is best to leave him to it, the C.S.A will deal with your case on it's merits.
    If his boss does this(doubtful) tell the C.S.A of your concerns.
    His employer will have to falsify returns to the tax office etc, it won't be worth his while. If the tax office were informed, they would look into his practices with a microscope, does his boss value him that much?

    Do you now allow your son to travel in a car that is not taxed or MOT'd and with a driver is not licenced in order for his father to learn responsibility, or have you stopped contact?

  • There are ways of getting your boss to reduce wages as my ex did this to try to get out of paying. Csa take ages to do first assessment so it'll probably take ages to do another one.
    Be warned though my ex was just about to have an attachment of earnings taken out of his wages and so he told the csa he had left his job. The reality was that he was still working at the same place but he had gone self employed and had an arrangement with his boss!!!!!
    After 6 years and the csa doing everything in their power we have still had no luck as even though a court issued a warrant for his arrest they will not action it as they don't get paid enough to do so!!!!!
    Keep reporting him for the lack of insurance, etc. Every time you see him as he is a risk to others.

  • Could anyone advise me on this situation: my husband has been trying to get his CSA payment to his eldest son stopped for 1 year since the son left home and secured a well paid job at 17 years of age. Of course, the CSA are impenetrable, unhelpful and the money still gets taken out of his wage each month. DOES THE MOTHER HAVE ANY LEGAL RESPONSIBILITY TO INFORM THE CSA and if she does what could be the legal come back on her for accepting the money for 12 months.

    My ex is self employed but I am fairly sure he is paid by cheque for the work he does. I have never been in contact with the CSA as I know he would just cut contact with our son the moment I do (he did this with children from his first marriage). I've always thought that there was no point stirring things up as I probably wouldn't get any money and my son would lose contact with his Dad and I would never get a break.

    But I do get frustrated and upset especially when I have learnt he has re-mortgaged our old marital home to fund his lifestyle (he bought me out when we separated) to the tune of around 80k in the last 4 years but has our son seen a penny of it? :mad:

    Surely if he is being paid by cheque, there would be a paper trail? Do the CSA just take his word for what he earns and look at his (probably well doctored) accounts? If so, there is no point me doing anything.

    The thing is, I read these threads and I know people who have ex partners who are PAYE and yet the CSA still fail to collect, so what chance have I got?

    Unfortunately Self Employed are notoriously difficult to get any money out of if they don't want to pay. In order to prove his income, you would have to know who has paid him in order to report this information to the CSA fraud dept. Other than that, if he refuses to give info, then the CSA have the power to go direct to the Inland Revenue for info, but it is likely that he may have told untruths to them too!

    You can apply for a Variation on his lifestyle being inconsistent with his declared income but again, the onus is on YOU to prove his lifestyle and how he gets his income. He may claim that it is funded by credit cards, a new partner loans etc, but a Tribunal would ask him to provide evidence of his claims.

    The CSA can check to see if the PWC is still in receipt of Child Benefit, if she is then this is enough for them to keep taking the money. If you suspect she is committing fraud by continuing to claim Child benefit then you need to report it to them to investigate.

    I know the company that would be paying him, but of course, as he's self employed he probably has lots of "allowable" expenses that he will claim against any payments he receives. Of course, he could always ask that company to pay his GF or friend the money if the CSA got involved. the owner of the company he does most of the work for is his best friend. :rolleyes:

    A lot of his lifestyle probably is funded by credit cards, loans etc. hence the re-mortgaging.

    He doesn't have huge amounts of material trappings, yes he has a reasonable car and a boat but to be honest most of is probably just being wasted on things like eating out and bad buys etc.

    But he does earn money and I'm not greedy and would be OK if he just gave me £10 a week if that's all he can afford. I just get annoyed that he doesn't have to cough up anything for our son simply because he CHOOSES not to. :mad:

    I presume that the PRC isn't claiming child benefit. I'm wondering whther she has a responsibility to inform CSA if she no longer is elibible for CSA itself. She is taking NRP's CSA money, though the son is earning more than the dad and he doesn't live at home.
