PRC - do they have an obligation to inform CSA or other Government department's that s/he is no longer eligible for CSA seeing as son has left home and working away. DOES THE MOTHER , in my case, HAVE ANY LEGAL RESPONSIBILITY TO INFORM THE CSA. The money is still going out of NRP wage everymonth - how do I know that it is going to her. If it is and she is accepting it, what could be the legal come back on her for accepting the money for 12 months plus?

Hi,
I am at the end of a 2 year plus battle via the CSA and I was wondering if anybody could confirm if this was correct.
The father receives,
A Service Disablity Pension,
A Dss benefit,
A Dss Mobility Car
and is working.
Due to the fact that he receives a DSS benefit, then his child support maintenace is limited to just £5.00 a week, regardless of his income ?
Is it correct that a man could have an income of say £400, £500 , or higher and still only legally have to pay the £5.00 a week ?
I have contacted CAB today , but would welcome the input of anybody else who may have been in a similar situation.

If you are only dealing with your caseworker you will probably have no joy.
Speak with a complaints resolution officer. Take their name and direct phone number. Also involve your MP. Their assistant can phone a parliamentary hotline number.
The child benefit should have been stopped as the son is working full time.

Do you know for sure the PWC is actually no longer eligible for CSA?
As said in another thread the CSA payments stop when child benefit stops, perhaps phone the CSA and child benefit officeHit the snitch button!member #1 of the official warning clique.:j:D

The Csa will still be able to do an assessment but the likely hood of it being a realistic one is highly unlikely!! I went through all of this years ago. My ex was just about to have money taken from his wages when he so say left his job. What he really did was stay doing exactly the same job at the same place but just went self-employed. His best mate was also his boss!!!

Even with a warrant out for his arrest I am still having no luck as the court in Gloucester is on of only a few in the country who will not action warrants as they say the CSA do not pay them enough to do so. (Can't see the point in a court issuing a warrant if they are unwilling to action it).
After 6 years I have receiving hardly anything and nothing for 4 years.
My point is don't hold your breath!
Having said this perhaps you could tell your ex that you are going to go to the CSA but you wanted to give him a chance to pay maintenance himself and perhaps you could come to some sort of arrangement. Tell him that you are finding it difficult to provide all of the things which your son needs and would he help. Perhaps if he doesn't want to pay you maintenance he may buy your son clothes, shoes, etc on a regular basis then he will be supporting him and also your son will still have a relationship with his father.

I'm not sure either. Have you taken this up via your MP? WHAT???? The CSA will have to pay the standard court fees anyway, just like they do for a liability order. The fees are then added on to the arrears. Have you got this confirmed by the court or is this the CSA talking?
EDIT: I was told that given the NRP is self employed there is little point in sending them to jail, because, although the arrears remain there on paper they are deemed uncollectable...UNLESS...the NRP becomes salaried later on. And the NRP is not going to do that!0 -
She has a moral responsibility but there are no legal penalties for her, if she doesn't inform the CSA.
Another gem, is that should your husband be able to recover his payements......it actually comes out of the taxpayers pot. The CSA don't recover it from the mother

COCs can take forever. MP is the way forward.The CSA will take more notice.0

The child for whom, the CSA has been claimed is in the army earning a sizeable amount of money. The money is still going out of the wage packet. i cannot believe that the PRC is still eligible as the son isn't with her and lives independently. If the CSA automatically stops along with the child benefit then where has all the money for the last year plus gone? How does this system work?
