kelloggs36 wrote:This isn't true. They are only uncollectable for the period that they are in jail. When they are out again, they are collectable again. They can return to other enforcement action at a later date, even if they have been to jail. So, if they buy a house, a charging order can be put on after he has been to jail, and then an order for sale made, or they can send the bailiffs in again.
Thanks for the info, K.
I was told that info in the presence of my MP by a senior case manager. I was also told they were going for an order of sale. But,of course, he started "complying" again for a while, so it was stopped. He has now stopped complying.0 -
There's a surprise! I hope you have got straight onto them and have now asked them to start the process of applying for the Order. The senior case officer should make a decision as to whether the case is suitable for an order for sale and will take into consideration the following things
The value of the house compared to the amount of equity
The amount of arrears
Whether or not there are other children involved, especially if they live in the same house as the NRP
His payment history!!
If there are any other suitable methods of enforcement that can be used instead
the list isn't exhaustive, but providing they have the charging orders on the house, there is no reason why the case cannot be considered if he is no longer complying.0 -

Don't you think I already presented those facts to him? ( senior case manager...2nd meeting.) They could have got the NRP under the criteria. The MP didn't have a clue about the legislation.Afterwards I provided all the evidence to them. There was heaps. But then the NRP started to "comply"!
MPs are basically postmen and to a certain extent they can help. But then you hit a brick wall.. and start receiving pathehic letters from new parliamentary under secretaries (!) of state. " Hi ( christian name) See you in the house of commons bar soon for a G&T soon, Yours truly, Bill "
Bloody disgraceful. But this is why I like coming on here. Cos I can relate to people in the same position as mysel
And I can't go any higher than it is already. I have become mute, cos of you know who. Lets see what develops...
( Still can't get it into my head how he has blatantly lied to me about the jail bit and arrears regarding self employed NRPs. Nevertheless he is the only member of CSA staff I truly respect. I will have it out with him sooner or later.)0 -

Why won't they put a charging order on his house ( I don't know details of your case )? I presume he is not renting. Then they could go for an order of sale?
When he sold his house and I was paid for the charging order he moved in with his wife. But they have since bought the house but apparently it is only in her name so unfortunately can't do anything about it.
I will contact our mp though.

Woe betide him if she ever decides to divorce him.
What other options have the CSA tried? Third party debt orders?
This link may prove useful.

I think it would be rather amusing if she did divorce him! He is her 3rd husband and she seems to have kids by them, spend all their money then divorce them and take them for anything they have left!! I think she will probably stick around with him for a while though as his dad is loaded and he will inherit everything! (I knew her before they got together which is why I know these things) Hopefully Karma will sort him out!!:rotfl:
They tried all those things except for revoking his driving licence as his wife would just drive him around.
The debt order was a great success as I got around £32!!! He seems to not have a lot of money in his account! I saw his step-son at the post office yesterday though and he was putting money into ex's bank account (not sure how much but wasn't being nosy just overheard conversation as I was right behind him in que) so I'm thinking I'm going to phone the CSA and try and get them to go for another debt order as perhaps he has got sloppy about not having money in his account as they haven't bothered doing that for ages!!
I know that this all sounds wicked but he makes me so angry:mad:
We asked him to allow my husband to adopt my daughter as he is all she has known for 6 years now. She does know who her father is but she doesn't want to see him as he was abusive towards me (unfortunately she witnessed lots of it) and after we left him he was abusive to her:mad: . It's a good job she doesn't want to see him as he did not even acknowledge her when she was stood right next to him at a village carnival:mad: . If he allowed my husband to adopt her then he would not have to pay any more money towards her (not that he does anyway) but he says that he might decide he wants to see her and we won't get any money off him anyway so why should he do anything like that as if he fancies taking us to court he will!!!
Unfortunately I chose really badly and ended up with a complete git but at least I saw the light and got rid of him:rotfl:19/03/2007 Start weight 15st 7lbs

Hi
I have started a thread about going to a CSA tribunal-but would like to pick your brains on here too.
What else can I do to get the powers that be to take me seriously and do something about my lying toad of an ex?
He pays £94 a month for 2 teenagers -he works for the family firm, his salary has not increased in 9 years-it has decreased recently(and he has bumped his pension payments right up)
I am getting into debt trouble as I cannot afford to keep my kids-teenies are so expensive to run.
Any ideas welcome..
Thanks

Is it a Ltd company? If so, Companies House will have info about turn over and directors' income. Need some more detailed info really before it is possible to advise. PM me if you want and I will help if I can. I won my case for Lifestyle Inconsistent plus I used to be a Face to Face Officer with the CSA.0

Hi not sure im posting in the correct place, so apologies if im not, but I've been divorced from my ex since Feb 07 (yipee!) We have two girls aged 8 and 9, up until september last year he paid maintence of £238 per month for them. However my ex left his job, and now lives with his new partner about 130 miles away.
He hasn't really worked since, so i haven't recieved any money towards the girls. He is however doing odd jobs for people, but all cash! I think as his new partner who has 2 kids earns 30K a year, he doesn't really need to work he makes a cheap babysitter i think.
Does anybody know if I were to contact the CSA would they take her earnings into account? It's just i've managed without any contribution from him since september, but I recently had an operation and can't work for 6 weeks and am only getting SSP and tax credits. To make it better i'm still having to pay my childminder to keep my place!!
Any advice would be cool!0
