    Neither would I, but if it is too hard for you to live in your community because of your husband's crime, may it not now be better to take the opportunity to move and start afresh elsewhere? You could just then say that your husband and yourself had split up. (not a lie!).

  • Thank you all so much- I've been for a really long walk in the fresh air today to try and clear my head today, I've not slept too well over the last couple of days :( I'm trying to go through paperwork, but this is something my husband sorted out and I can't find half the stuff I need to help me.

    I've got the mortgage stuff saying we were in arrears, and bank statement saying that he has/had debts of £6,000 (3k OD and 3k loans dating back to when he was with his ex), all my statements showing what we actually got for the house and how we've lived off it for the whole of 2008- Unfortunately I really don't think that this is going to be enough to help me stay here. I'm worried about my landlord as well- he's a really decent chap and I don't want to screw him over.

    As I've said, living here isn't a problem, because no-one knows what my (ex) husband did. I just can't afford a deposit and months rent on another place anywhere :(

    It sounds to me like you've found the paperwork to prove you couldn't gave afforded to stay living there without selling and renting back -- and from previous links posted on here it would appear that's what you need.

    Go for it girl -- show them you're made of sterner stuff than they thought, and that you're not going to let them walk all over you :T

    Shelter might be able to tell you if there is a local Tenancy Bond scheme in your area.

    I used to work for social services and to be honest this is exactly the sort of thing your local SS should be dealing with. In my view as ( ex social worker) you have done all you needed to do to keep your child safe re the supervision, and this has brought you significant financial detriment ( couldnt work)

    I would be speaking to your socail worker and seeing what help they can co-ordinate for you to move.

    It sounds like you are in a close knit community? Will it be very difficult for you to live a lie going forward? With the stress of dealing with your new life, i think it might be very difficult to keep the truth under wraps and also that it might not actually do you any good to do that.

    Im also thinking that a move might do you good x

    So the problem is the "rent back" agreement, which means you can't claim HB for 5 years. This is, I guess, to stop people selling a house in order to claim HB without actually moving out.

    So - you may have to move. As has been pointed out you'd be unlikely to claim as much as 900 per month so you'll need to look for something around the level that the local HB people are prepared to pay for a household of your size. Best place for advice is CAB or Shelter or similar charities.
  • Hey everyone!

    Well, I managed to get an emergency appointment with housing today and they are looking over my case again. I've got too get a letter from SS explaining about me not being able to work so I could protect my daughter and stepson. I've also got to do a letter explaining my husband didn't work due to stress and depression with the court cases. They are going to re-evaluate my case after those 2 letters are in, so fingers crossed.

    Also on a good note, the level of HB I can claim for my postcode is actually £956 per month, which is more than my rent. I also enquired about the possibility of a tenancy bond scheme or something like it and my council does run one!

    I'll update more a bit later, when my daughter goes to bed.
    All in all (hopefully) a pretty successful day- yey!
