Even so you need to appeal this. IMO you have good grounds and a specialist advisor can go through it all with you and prepare a submission for the LAI'll get you, my pretty, and your little dog too!0 -

Hi LAC
Your story sounds awful! (((Hugs))).
I'll have to leave the housing issues to someone more knowledgeable but I can give you some idea of some of the child-related benefits/grants you can get.
Obviously you will get Child Benefit – current rates being £20pw for your first child and £13.20pw for the second and subsequent ones. I believe if you are on Income Support these can be paid weekly instead of 4 weekly to enable you to budget.

As your baby is due in May you will be entitled to the new Health in Pregnancy grant – a one-off non-means tested payment of £190, which you can claim from the 25th week of pregnancy.

As you are on Income Support, you will also be able to claim the Sure Start Maternity Grant – a one-off payment of £500 which ONLY be claimed in the following period: from 11 weeks BEFORE the baby is due to the time the baby is 3 months old.

I'll have a look around and see if there is anything I may have missed.
Stay strong! You've got this far – things will get easier!

I think there is a ruling that you can't claim Housing Benefit on a house you once owned unless you have rented it for several years.
However, there is a chance you could still get it according to this article, especially Sections E14, E15, E16.

I'd try the CAB for advice and assistance.(AKA HRH_MUngo)

Imagine someone holding forth on biology whose only knowledge of the subject is the Book of British Birds, and you have a rough idea of what it feels like to read Richard Dawkins on theology: Terry Eagleton0 -
briona- Thank you I hadn't heard of the Health in Pregnancy grant. I'll be applying for that. I think I've got the other forms sorted- even my milk tokens lol.
seven-day-weekend- Thank you. I think that's what the bloke on the phone was talking about.
I'm making an emergency meeting with the housing on Monday, but everyones help on here has been amazing. I've put off posting on here when my hubby first got put in because I didn't know what people would think of me sticking by him until the end of the case until conviction, but you lot really are fab. Thank you.0 -
The five year rule is because you have previously owned the house. You cannot have benefit paid on a house you have owned within the last five years, unless you can show that selling the house and renting it back was the only way you could keep living in it. Could you show you were in mortgage arrears or were in danger of being reposessed due to unpaid secured loans?
The alternative would be renting elsewhere, and although it would be an absolute nightmare for you to have to move, it might be a fresh start for you. If the current house is in disrepair, it may even work out better for you to move in the long run?

Just wanted to send you a hug.
Social Services DO have a duty to help you or at least advise you. With 2 children and 1 on the way and your husband(ex + given the charges)in prison, I would assume you would be counted as vulnerable.
I have never heard of the HB 5 year rule either
CAB would be a good place to start.
Coucil may offer to house you if SS would get involved.
Take care.
