    I wish I had found this thread earlier too :(

    I paid the £49.50 Admin Fee to The Credit People, was also guranteed this so called loan!
    I spoke to one of the (well supposed to have been) managers in the office, and he was incredibly rude when I asked him where the Agreement Form was, I was meant to receive, all I got was an Application Form, and a generated application form which was obviously details they'd taken over the phone for me.

    I got on to Consumer Direct, who told me to write a letter (within my 14 days) asking for a full refund, I did this, and sent it off recorded delivery.
    Had a letter back from them about 3 days after, basically saying, I hadn't explained the outcome of the loan application, so I needed to write another letter to them, explaining the outcome, which was the same as everyone else, ring this number at £1.50 per minute, 20 minute phone call.
    There was no way I was doing that, so I explained this in the 2nd letter I sent to a 'David Williams' at The Credit People.

    I have received a letter back this morning, and it goes on to say;

    Dear Mrs ***

    In reply to your recent correspondence requesting a refund. When applying for our service you signed in agreement (have never received an agreement from them) with our terms and conditions which states 'The applicant should take into consideration that once an application form has been received by the company, the applicant cannot cancel the service for any reason'

    Unfortunately you will be unable to withdraw from the service until it is fully complete.

    If you have any queries or problems then contact our customer services team between 9.30a.m and 5p.m Monday to Friday on 0844 544 4010.

    As if I am going to ring them, after the experience over the phone I had (The guy was that rude, first time I spoke to him (think his name was Jack) he wouldn't let me get a word in edge ways, so I said he was being rather rude, which resulted in him telling me 'No I'm not being rude, If I was being rude, I'd do this, and he put the phone down on me, second time I spoke to him, and questioned him on where on earth the Agreement Form was I was supposed to receive, he never answered my qs, just told me He couldn't stand my voice, so I'm putting you through to someone else, and he was meant to be a manager!)

    Does anyone know where I can now go with this? I have contacted Consumer Direct again, and they are passing it through to Trading Standards, who will ring me within the next 3 working days.

    Everyone elses comments are really interesting, and it goes to show there telling everyone the same thing.

    Steps to take if you have been scammed by them, and also if our willing to help bring them to justice please send me you experiance by email more details in step4

    Step 1.

    write a letter and give them 14 day in which to refund your money send it recorded delivery so you know when they received it (this is the only letter you need to send) explain in it that you were miss sold and you have been on a forum where others were told exactly the same thing. also mention that you have contacted the Dept. for fair trading and reported the incident as this is the next step you need to do. (you only have to do this once if they dont refund it and try to get you to do other steps dont move to STEP2)

    Step 2.

    Call the dept of Fair trading and report the incident ( the more reports the higher the urgency becomes for them to investigate this issue) tell them all the steps you have taken and what they have done (move on after this to step 3)


    Step 3.

    Call your bank register a dispute tell them the exacts of what has happened and they are refusing to refund your money you can only raise a despute if you paid by Credit card or Direct debit)

    Step 4.

    If you wish to take this further I am in the process of getting other people together to take the credit people to court for our lost money and compensation if you wish to join this claim and take it to court under a mass action then please email Richard.a.f@hotmail.co.uk this will not only get you more money than you paid them but they will have to pay out court costs too if they dont pay a court baliff will turn up at their door and take 10's of thousands of £ worth of property to make the payments (maybe more or less depending on how many people wish to join the court action) mention that you will be doing this in the letter as this might help the refund.


    The Dept. of fair trading also told me that what they are doing is a criminal offence so if the money isn't refunded and the D.F.T investigate and find them guilty they will be dealt with through the criminal channels ie police and criminal courts.

    Im now typing the letter to them and sending it today recorded delivery I will post a copy of the letter on here and will let you all know the out come.

    Remember if you want to take them to court for your money if you dont get it by going through the right channels and dont have too much time to deal with the legal action or just want to get you money back email me on the above email addy and i can deal with it as im stuck at home after a failed operation which has stuck me on DLA so i have pleanty of time and i love taking on companies that are in the wrong!!!

    I too have had dealings with this company and when I tried to enquire about getting my fee refunded I was met with either a constantly ringing phone or it was answered, no one spoke and then they put the phone down

    I have now gone to the Financial Ombudsman but have had to wait 8 weeks as advised by the ombudsman to see if they would get in touch (Is he having a laugh) so cos they haven't I can now submit my form to the ombudsman and hopefully get my money back

    Heres hoping. I just wonder if they are scared of the ombudsman or if they think they are untouchable?

    Well I contacted my bank, to do a Dispute Claim, they can't help me, as I have received paperwork from The Credit People. I have rung OFT and they have told me to contact Trading Standards, does anyone know the number for them? I have been on to there website, but its just telling me to go through to Consumer Direct, whom I have already spoken to, and told me to speak to Trading Standards. I seem to be going round in circles.

    Dear [owner/manager’s name or Sir/Madam]

    Misrepresentation Act 1967

    I entered into an agreement with your company on [date] at a cost of [price] via *cash/cheque/debit/credit card [delete as appropriate].

    At the time of purchase, it was indicated by a representative of your company [insert name if known] that the service/goods would include

      - I have since discovered that this is not the case, therefore I feel the contract was misrepresented to me. As such, I will have no option but the cancel the contract without penalty/seek damages [delete as appropriate] in accordance with the Misrepresentation Act 1967. I am giving you 14 days to refund the full amount of [£.....] this will be my only letter, I will not accept any form of delay tactics, reduced amount on a refund due to admin fees etc. If I do not receive the full refund I will be in contact with the Office of Fair trading again to report this matter, The Daily Mail Money Section and any other relevant bodies. [ONLY ADD THIS SECTION IF YOUR BANK HAS TOLD YOU THIS] I am also in contact with my bank who have told me if you do not refund the money they will initiate a charge back.     GUIDANCE ON USING COMPLAINT LETTER TEMPLATES

    The Consumer Direct complaint letter templates can help you make a written complaint, if you have a problem with goods or services.
    Customise your letter
    You will have to make some changes to a template before you send it. This includes:
    • Add your name, address and telephone number (and/or email address).
    • Add the trader’s name and address.
    • Add the date on which you send the letter.
    • Add your name at the bottom.
    • Sign the letter in the space above your name.
    In some letters, you will be requesting a response within 7/14 days [delete as applicable]. Make sure you choose which is more suitable for you. If you are complaining about a long-running problem and need it resolved quickly, 7 or 10 days might be a suitable period. If this is a recent problem, it is more reasonable to allow 14 days for the trader to resolve it. But always allow a minimum of 7 days.
    You will also need to add the specific details of your complaint. Where you see text such as [explain what you want i.e. refund/repair/replacement], you will need to choose one of the options that are listed or write in the details yourself. Be as clear and straight-forward as you can when describing the problem.
    Make sure you remove all the [ and ] symbols afterwards.
    Before you send the letter
    • Address it to a named person if possible, such as the Managing Director.
    • Keep a copy for yourself.
    • If you sent a letter previously, enclose a copy of it with the current letter.
    • If necessary, include a copy of proof of purchase, eg a receipt or contract.
    When you send the letter
    • Send the letter by recorded delivery, so you can prove that you sent it and track its progress. You will have to ask at the Post Office for this service.
    • Note the date by which you have requested a response (eg 7 days later).

    Sam this is wrong if you were mislead and paid the money over the phone before your paperwork arrived this falls under the 1967 misrepresentation act, call your bank up and make sure they understand this a charge back is possible

    Trading Standards have contacted me today, they then rang me back, and mentioned contacting my bank again by letter, under the act mentioned above, so fingers crossed the bank help me this time.

    Just spoken to my bank, and its not something that they deal with (doesn't meet there criteria) as its more of a legal thing, so they advised me to either go back to trading standards or CAB :(
    I guess I will take a copy of the above letter, send that and see what happens!
  • I have tried to contact them through their email as well, but their website doesnt seem to exist???? Anyone else having this problem?

    I rang last week and complained, however I was told their advisors never guarentee loans, strange that because after reading loads of these threads, it like they read it from a script!!

    I've just had a narrow escape with this crowd. Called today about a loan for £1000 for a car and everything seemed to be going well until they asked for a £49.50 paperwork fee, which I thought was a bit odd. Told them I'd call them back, and luckily I decided to do a bit of research on them and found this forum and I'm really glad I did. Thanks for all these warnings and I'm just sorry for everyone that's been conned by this lot.
