We've had 2 members of the debt team off, one of who is still off on long term sick leave, as is our manager, so it's all been turned upside down really. But of course the clients keep on coming! lolTotal 'Failed Business' Debt £29,043

Hi
It sounds like you would qualify for a DRO provided you meet the criteria of (1) debts under 15k, (2) surplus income under £50 per month and (3) no significant assets - any car valued under £1000.
Moving isn't a problem in itself but if you're not on the electoral roll then getting your Experian report may involve evidencing where you are now. If you require your address to be withheld from the insolvency register then that is more of a problem for your Intermediary but its possible.
ccjs must be included and an experian report will show those granted in the past six years. Do you have older ones?
The sky contract will be your mum's debt if it is not paid. I would be happy to allow an allowance for the phone element in your expenditure statement but Sky programmes themselves are not an allowable expense. Hopefully you've got their free broadband and a basic package!
I would ignore the DHP as we'd probly struggle to get to the point of submission in 2 months anyway.

CCJs are included yes, but credit reports don't show everything, so you may need to spend some time tracing your debts with your intermediary to ensure you've covered all bases.
The discretionary housing payment would only be taken into account if you made an application while it was still running, and you'd just need to tell them when it stopped.
Thanks both - I really appreciate the help.
I don't have the free internet because I use it too much due to being indoors a lot (I have agoraphobia, plus other problems). I'm on a basic tv contract, but can understand why that wouldn't be included.
I'll do a rough list of what goes out every month and hopefully someone could let me know if I look eligible..
Debts around £6000 in total
I only have all the normal household things like sofa, bed, tv etc.
Benefits (not including HB) £377. I'm meant to be on DLA but can't handle the stress of applying right now
Extra to pay on rent is £40 with discretionary housing payment and £100 without.
Electric: £50
Water: £10
Gas: £35
Land line:£13
Internet: £15 ish
Mobile: £10
TV license: £12
Food: £100
Pet food, litter etc: £50
Taxis: £50 - they're a must because of my conditions.
Total: 385
Are these all allowed?
Thanks in advance

In terms of a DRO your expenditure is fine as it's under the £50 limit for allowable expenditure.Total 'Failed Business' Debt £29,043

It won't neccesarily be fraud, but it would be a transaction at undervalue (ie you gave away an asset at below market value) and a DRO application may be rejected on that basis.
Yes I am still on the mortgage at present, I can't take my name off until my husband can pay it on his own for three months.
Are there any other options for me?0 -

Hi Guys.
I actually need some advice. My DRO has now ended YAY. I did a search on experian to see what my file is like and there is no MENTION of my DRO at all..?. Under the public record information section (bankruptcies etc) it says 0 no records.
I should say however that for some reason they do have my home address as the one i lived at BEFORE the DRO was taken out. I thought they would have been updated when the IS granted my DRO.
Can anyone shed any light on this?.0 -

Yes it's very strange. I have today updated the file with my current address, you can do this on-line. I think i'll give it a couple of days and see if it sorts it's self out.0
