My DRO has recently ended and I'm now thinking about doing the credit file clean up. I am going to amend and send fermi's letter on this link but I was wondering if I still need to quote the guidance at the end of the letter (Relevant Extracts from Bankruptcy - A Guide for the Public – 2010 issued by the ICO) as it's for a DRO not bankruptcy? If not is there any substitute guidance I should add to the letter that relates to a DRO? Thanks.

    Nightmare!

A creditor is now saying the amount on mr DRO is lower than the actual amount i owe and is now asking for the difference to be paid.

Can the amount on a DRO be amended if it was incorrect?

No i don't think it can. I am sure i was advised by my CAB rep to actually put more on for each debt to cover any interest that may have accured.

Mind you. Did you not get the figures the day before whomever did your DRO put it through the system?. I am sure they also advise you do that.

Theoretically they can do this, but I've not heard of anyone taking court action for the 'shortfall' before.

Is this a 'big name' creditor? How much is the shortfall and do you agree with their sums?

Does anybody know how I can see the details of a DRO (I have the number) - my brother in law has asked for a loan from us and has a DRO. He has said he wants the money to pay his council tax but I really don't believe him. I'm sure I read somewhere that you can include council tax in a DRO

Check the Individual Insolvency Register online, which you can find by googling it

Thanks for that - I know he has a DRO as it is on the register but how can I find our what is included in his DRO. He says he needs money for old council tax debt (over 1000 pounds!) and we are reluctant to lend it to him if he has already included it in his DRO as he may want the money for something else.

Unless he tells you or you're a creditor, you won't be able to find out the details of what's included in a debt relief order.

If it was owed before the DRO it should've been included by his AI so I'd be very surprised if it wasn't.

End of the day, if you're not sure, don't lend him the money as it's clear he's had money problems so how can you be sure you'll get it back?

    DON'T lend.

Was the debt forgotten about as it would take the total debts over £15,000?

I did get the balances the day before, but i checked the website and didn't phone them. The amount on the website was incorrect apparently.

The CCCS never advised me to put more down than i actually owed, that does make sense.

It was a payday loan lender, ive come to an agreement with them, it wasnt a massive amount but its just annoying.

I guess the lesson to be learned here is, if there's any doubt at all, then over-estimate. Especially when it comes to payday lenders.

Glad you got it sorted - hope that was the last of your problems.
