    You haven't really answered my question as a phone call does not count as acknowledgement. What is it? And when did you last make a payment to it, or a written acknowledgement? If this is ancient and there has been a six-year gap, it's going to be statute barred and unenforceable (but should still have been included).

    I'm hoping you didn't leave it out cos you were near the 15k limit.

    I've never made a payment for it.

    Basically in my old flat I was under the impression I didn't have to pay water. I never received a bill for it and even enquired and was told it was in my landlords name and couldn't be changed. Anyway I received a letter asking me to call a company, I did and they said they have been asked to track me to pay this bill, I explained to them I'd never got a bill and as far as I was aware I didn't have to pay for it. The person asked for my number and said that someone would call me, anyway I never got a call back so I assumed that it was the end of it. Just after I got my DRO (1/9/2011) I received another letter asking me to pay the debt.

    I'm not near the 15,000 k limit my debts total about £7,000 Also rang the DRO unit and sent off paperwork to the social fund people as I was advised.

    Did you ask your case worker about this debt, considering they contacted you before your application was made?

    Surely if you knew you had another debt you personally would want that put on your dro...

    Also..if the debt is in your landlords name why are they asking you for it? Have you got it in writing on your tenancy that the water is included in your rent?

  • Hi, quick question and wandering if anyone can help. was made redundant a few months ago and am at the latter stages of applying for a dro, the cccs are sending my thing to take to the post office to pay £90. ive a problem which is my car tax and mot is due which i cant afford and i do NEED my car as my sons school isnt on a bus route and im also doing voluntary work. was thinking of applying for a budgeting loan but am worried this could affect my dro, can anyone confirm if it would or not or have any other suggestions???? thanks

    Hi, after you have received and paid your £90...a few days later your dro should be approved if accepted!
    You must not take out credit of £500 or more without telling the lender that you have
    a DRO.

    So in theory..IMO once the DRO is in place yes you can get credit if you stay within the rules of your DRO

    BUT

    surely...if your in a situation to be going for a DRO the last thing you want to do is get more credit?!?

    I know its the last thing i want to do, and i have no intention of getting credit again!!

    If you apply for the credit prior to the DRO being submitted, you will have to include the debt within the DRO but then this means a risk of it being appealed for taking credit out with no intention of repaying, as you know you are doing a DRO.
    you could apply after your DRO is in place, but this would mean you are liable for repaying the debt, which will then reduce your weekly income from whatever benefits you receive...
  • Thanks for the replies...yes the last thing id want is more credit but I didnt really see this as a loan as such, I wouldnt even dream of getting actual loans or cards etc nowadays. Ive decided to take my car off the road for now but id does unfortunately mean that I have to give up my voluntary work and it will be an hours journey each way to dropping my son off at school but hey ho I guess thats what i will have to do!!!

  • First of all, a quick thankyou to those members who helped me with some queries I had a couple of months back when I was earlier in the process of sorting out my DRO :)

    It has been a bit of a drawn out saga, due in part to:

    - myself initially not having the fee ready, followed by
    - my intermediary being fairly dreadful, a really poor solictiors, followed finally by
    - one of my creditors telling me my debt was being sold off, meaning I didn't know who the actual creditor to name on the application was, and after four weeks of waiting for the debt to arrive with one of the two supposed buyers, the creditor tells me that they still have it....

    Anyway, I finally got my application finished last Wednesday- and my name turned up on the Insolvency Register the following day!!!!! Did I get lucky there? I was under the impression I was looking at up to a fortnight or longer...

    I just have one query. I've notified all of my creditors, who have confirmed that accounts are being closed and that no further contact will be made, besides written confirmations- but I'm just slightly concerned about one creditor- good old Wonga.

    I had fallen into that horrendous trap of falling behind with my finances and was relying on a Wonga loan each fortnight, which I would pay off on my benefit day, but then had to borrow again to get myself through- thus exacerbating my situation. I took my final loan out on the 7th September, which I then included on my DRO. I spoke to Wonga a day or two after this loan and explained my position- they told me to contact them once I'd applied for the order at an e-mail address of detbtmanagement@wonga.com, which I have today. They said that once I notified them of my situation, they'd put my account on hold for 38 days to allow me time for my order to be sorted, in which time they wouldn't collect nor add interest to the account.

    I made the amount in the DRO the amount due in full on payment day (this Wednesday, the 28th) and notified them today (via e-mail) that the DRO was in place and that they confirm to me that they will not attempting to take the full, or indeed any, amount from my account this Wednesday. I also specified that no further interest could be applied and that I hoped they would respond quickly and efficiently. I have heard nothing from them so far and I was wondering what the risk is that they may attempt to collect this Wednesday. They would be unsuccessful as there will not be enough in there to cover it- but would they try to take a smaller amount?

    Now that my order is in place and all the pressure is off my shoulders, I intend to live religiously by my budget from now on- but that would be made difficult if they try to take my money on Wednesday, as everything has been carefully accounted for.

    If anyone has any advice regarding my position and how best to handle the situation should any difficulty arise, I'd be ever so grateful.

    This one niggle aside, I can't begin to describe how relieved I've felt over the past few days and how much I'm looking forward to starting all over again :)

    If Wonga is on your DRO as stated then they are not allowed to take any money from you, and vice versa your not allowed to pay them anything! If they do, contact them again with your DRO number and explain they should not have taken it and to get it returned to you.

    Is it set up on direct debit? if so...cancel it with your bank ;)
